COUNTY BOARD MINUTES

SEPTEMBER 4 & 5, 2006

 

The Courthouse and offices were closed in observance of the Labor Day Holiday.

 

The Board convened on Tuesday, September 5, 2006 at 9:30 AM with a quorum present: Huegel, Boge, Pickar, Mattke. Schueth was absent. The meeting was called to order by Chairman Huegel. Mail was opened and distributed.

 

Motion by Boge, Seconded by Pickar, to approve agenda for September 4 & 5, 2006. All Ayes, with Motion Carried.

 

Motion by Pickar, Seconded by Mattke, to approve Board Minutes of August 28 & 29, 2006. Roll Call: Four Ayes. Motion Carried.

 

Motion by Pickar, Seconded by Mattke, to approve Fireworks Permit Application of Deb Underwood. Roll Call: Four Ayes. Motion Carried.

 

Kathy Babcock, Public Health Nursing Administrator, met with the Board to update FY2007 Local Public Health Services Contract modification changing case management line item to nursing and homecare line items. Change was approved by the Local Board of Health on September 5, 2006.

 

Jeannette Kottke, Secretary and Jannette Hendricks, President of the Chickasaw County Genealogical Society met with the Board to present their funding request for a joint purchase with the New Hampton Public Library of microfilm reader. Discussion followed, with the Board  deciding to fund a portion of the $4000.00 funding requirement.

 

Motion by Boge, Seconded Mattke, to approve funding $500.00 from the County Betterment portion of the Local Option Sales Tax, to the Chickasaw County Genealogical Society toward purchase of a microfilm reader. Roll Call: Four Ayes. Motion Carried.

 

County Engineer Dusten Rolando met with the Board to discuss road departmental activities.

 

Motion by Pickar, Seconded by Mattke, to approve and authorize Chairman Signature on permit for Iowa Telecom to place buried cable in county right of way thru 160th Street and along Stanley Avenue in Jacksonville Township. Roll Call: Four Ayes. Motion Carried.

 

Motion by Pickar, Seconded by Mattke, to approve and authorize Chairman Signature on permit for Iowa Telecom to remove buried cable and locate a new pedestal along 160th Street west of Windsor Avenue in Utica Township. Roll Call: Four Ayes. Motion Carried.

 

Updates included projects completed for bridges on Stevens and Stanley Avenue and re-grading on 220th Street traveled as a detour around bridge replacement projects on Highway 24. Engineer reviewed paving design changes and costs on 2.6 miles of county line road shared with Howard County, requesting approval for funding $39,450 for 50/50 cost share of double seal coating.   

 

Dave Knutson and Cathy Ollendick met with the Board to seek help for their new truck dealership dealer license application at 2176 225th St., New Hampton.   Discussion followed with Board members offering names of organizations for new business start-ups.

 

Jeanne Heit, Homemaker Administrator, met with the Board for several business items and an personnel update, as follows: Motion by Pickar, Seconded by Mattke to accept resignation of Susan Miller, as part-time homemaker effective July 24, 2006. Roll Call: Four Ayes. Motion Carried.

 

Motion by Boge, Seconded by Pickar, to approve change of status to full-time homemaker health aide for Cindy Mullins, effective September 8, 2006 as per union salary scale. Roll Call: Four Ayes. Motion Carried.

 

Motion by Boge, Seconded by Pickar, to approve Fireworks Permit Application of Bob Harrington. Roll Call: Four Ayes. Motion Carried.

 

The Board opened bids for 2007 county farm rental.   Those present included Dave Leichtman, on behalf of Ryan Toussaint; Robert Schellhorn; Gordon Davis Jr. and Bruce Lantzky.  Initial bids were opened and read as follows: Ryan Toussaint $120 acre; Robert Schellhorn $153 acre; Bruce Lantzky $135 acre; Bob & Paul Holschlag $145 acre; Gordon Davis Jr. $145.00 acre.  The bidding procedure allows for an optional second round option of raising the bid, if the bidder wishes, with second round bids, as follows: Ryan Toussaint $163.70 acre; Robert Schellhorn $197 acre; Bruce Lantzky $175 acre; Gordon Davis Jr. $165 acre.

 

Motion by Mattke, Seconded by Pickar, to accept bid $197.00 per acre by Robert Schellhorn for 2007 lease of 66.5 county farm rental and authorize Chairman Signature on contract.  Roll Call: Four Ayes. Motion Carried.

 

Board members recessed at 12 Noon for lunch with senior citizens at Chickasaw Centre and reconvened in the board room at 1:00 PM.

 

Motion by Pickar, Seconded by Mattke, to open the public hearing at 1:00 PM for conservation land acquisition loan of $40,000.00 from county. Roll Call: Four Ayes. Motion Carried.

 

Conservation Director Brian Moore and Assistant County Attorney Mark Huegel were present on behalf of the 160 acre land acquisition in Section 28 of Dayton Township from the Holy Family Church.   No comments had been received from the public.

 

Motion by Pickar, Seconded by Mattke, to close the public hearing at 1:10 PM.  Roll Call: Four Ayes. Motion Carried. 

 

Motion by Boge, Seconded by Pickar, to approve Resolution committing loan of $40,000 for conservation land acquisition.  Roll Call: Four Ayes. Motion Carried. RESOLUTION NO. 09-05-06-35. A Resolution Authorizing the Purchase of the Northeast Quarter of Section 28, Township 95 North, Range 13 West of the 5th P.M. in Chickasaw County, Iowa from the Holy Family Church, New Hampton, Iowa. WHEREAS, Chickasaw County, Iowa through the Chickasaw County Conservation Board is supportive of conservation practices and the preservation of wild life habitat, and  WHEREAS, The Holy Family Church is the owner of the Northeast Quarter of Section 28, Township 95 North, Range 13 West of the 5th P.M. in Chickasaw County, Iowa and wishes to sell said property to Chickasaw County, Iowa, and WHEREAS, Chickasaw County, Iowa through the Chickasaw County Board of Supervisors has prepared an Offer to Buy Real Estate and Acceptance form offering to purchase the Northeast Quarter of Section 28, Township 95 North, Range 13 West of the 5th P.M. in Chickasaw County, Iowa from The Holy Family Church, said offer to buy real estate form is marked Exhibit A and incorporated herein as though set forth verbatim, and WHEREAS, a public hearing was held in the board room of the Chickasaw County Board of Supervisors in the Chickasaw County Court House on the 5th day of September, 2006 on the purchase of the Northeast Quarter of Section 28, Township 95 North, Range 13 West of the 5th P.M. in Chickasaw County, Iowa from The Holy Family Church, and WHEREAS, to complete the purchase of the Northeast Quarter of Section 28, Township 95 North, Range 13 West of the 5th P.M. in Chickasaw County, Iowa from The Holy Family Church, the Chickasaw County Conservation Board may be required to obtain a loan in the amount of Forty Thousand dollars ($40,000.00) from the Chickasaw County Board of Supervisors, and  WHEREAS, it is in the best interest of Chickasaw County, Iowa and the citizens thereof to purchase said real estate from The Holy Family Church, New Hampton, Iowa. NOW, THEREFORE, BE IT RESOLVED by the Chickasaw County Board of Supervisors: 1. That the best interest of the citizens of Chickasaw County, Iowa, require that formal action be taken for the purchase of the Northeast Quarter of Section 28, Township 95 North, Range 13 West of the 5th P.M. in Chickasaw County, Iowa from The Holy Family Church. 2. That the Chickasaw County Board of Supervisors hereby authorizes the use of Forty Thousand dollars ($40,000.00) of general funds for the purchase of the Northeast Quarter of Section 28, Township 95 North, Range 13 West of the 5th P.M. in Chickasaw County, Iowa from The Holy Family Church. The Forty Thousand dollars ($40,000.00)    will be a loan from the Chickasaw County Board of Supervisors to the Chickasaw County Conservation Board. This loan will be repaid from the rental proceeds of the property and/or other grants or donations received for the purchase of said property. 3. That the Chairman of the Chickasaw County Board of Supervisors is duly authorized to sign and execute the attached Offer to Buy Real Estate and Acceptance marked Exhibit A, said Exhibit A is incorporated herein as though set forth verbatim. DONE THIS 5TH DAY OF SEPTEMBER, 2006 BY THE CHICKASAW COUNTY BOARD OF SUPERVISORS AT A MEETING HELD AT 1;00 OCLOCK P.M. ON SAID DATE. /ss/ John L. The Board received and filed combined eight Judicial District Audit Statements for the year ended June 30, 2005.  Also received and filed was the Deerfield Township Receipts & Disbursement Report FY 2005-06.  A Manure Management Plan Annual Update was received and filed for Larry Nilges for a site location in Bremer County, with application sites in Chickasaw County.

 

Motion by Pickar, Seconded by Boge, to adjourn at 1:25 PM. Four Ayes, with Motion Carried.
