COUNTY BOARD MINUTES

 MAY 9 & 10, 2011

 

The Board convened on Monday, May 9, 2011 with all members present:  Byrne, Holthaus, Andersen, and Zoll.  Absent:  Pickar.   The meeting was called to order by Vice Chairman Holthaus.  Mail was opened and distributed.  Also present member from the media.

 

Motion by Andersen, Seconded by Byrne to approve agenda for May 9 & 10, 2011.  Roll Call: All Ayes. Motion Carried.

 

Motion by Andersen, Seconded by Byrne to approve board minutes of May 2 & 3, 2011.   Roll Call:  All Ayes.  Motion Carried.

 

The Board discussed the date for the 2nd reading to the proposed Chickasaw County Zoning Ordinance dated 1-27-2011. Also present were Sheriff Marty Larsen, Assistant County Attorney, Mark Huegel, and County Attorney Pat Wegman.

 

Motion by Andersen, Seconded by Zoll to set the 2nd reading to the proposed Chickasaw County Zoning Ordinance dated 1-27-2011 for Tuesday, May 24, 2011 at 10:00 AM at the Community Services Building. Roll Call:  All Ayes. Motion Carried.

 

Motion by Zoll, Seconded by Andersen to approve Town & Country Club liquor license.  Roll Call:  All Ayes. Motion Carried.

 

Motion by Andersen, Seconded by Byrne to acknowledge and approve the resignation of Kathy Feuling as part-time scheduled nurse effective May 18, 2011.  Roll Call:  All Ayes. Motion Carried.

 

Supervisor Pickar present at 10:45 AM.

 

The County Engineer Dusten Rolando met with the Board to discuss road departmental activities.  Topics included:  maintenance and service of vehicles; maintenance of gravel roads; entrance permits, ditch cleaning permits; durapatch machine, getting today; cleaned out sand/salt shed; treated concrete; sign repair, as needed; fire extinguisher update on Tuesday; major overhaul on the Saude motorgrader; blading all week; reclaiming shoulders west ½, edge rut; dust control permits; spot rocking in various areas; brushing all week in various areas; tree removal in Nashua; budget amendment

FY 11.

 

Conservation Director Brian Moore met with the Board for a departmental update and to discuss the Price Wildlife Habitat Property.  Also present were Mary Schrandt-Prouty, Brad Schwickerath, Laurie Marzolf, Shane Pitkin, Elaine Govern, Conservation Board Members Tom Combs and Bill Raine, Howard County Conservation Director Harold Chapman, Rick Kramer, Doug Schueth, Jim Schueth, Duane Schwickerath, Mark Schwickerath, Nate Schwickerath, Suzanne Brownell, County Attorney Pat Wegman, Assistant County Attorney Mark Huegel, Roger Tiemessen and a member from the media.

 

Brian Moore updated the Board regarding the Conservation Board meeting held on May 2, 2011.  The Conservation Board motion carried 4 -1 to not sell the Price Wildlife Habitat, to address drainage and fencing issues, and look at possible funding sources for maintaining it.

 

Public comments and discussion followed.  It was the consensus of the Board for the Conservation Board and department to address the issues, funding to maintain the property, manpower and volunteers, 5 to 10 year financial plan and report to the Board by June 6, 2011.  

 

Public Health and Home Care Services Administrator Kathy Babcock met with the Board for a departmental update and review the compliance with Local Public Health Services Contract Condition report.

 

Motion by Andersen, Seconded by Byrne to adjourn the meeting at 12:25 PM.  Roll Call: All Ayes. Motion Carried.

 

The Board convened on Tuesday, May 10, 2011 with all members present:  Pickar, Zoll, Holthaus, Byrne, and Andersen. .  The meeting was called to order by Chairman Pickar. Mail was opened and distributed.  Also present was Jim Bruess as an observer.

 

Motion by Andersen, Seconded by Byrne to approve and authorize Chairman Signature on resolution correcting Resolution 04-26-11-13 and approving the minor subdivision plat of Parcel B in the N ½ -NW ¼ of Section 15, Township 95N, Range 11W Chickasaw County, Iowa.  Roll Call:  All Ayes. Motion Carried.  RESOLUTION 05-10-11-15: A RESOLUTION correcting resolution 04-26-11-13 and approving THE MINOR SUBDIVISION PLAT OF Parcel B in the N½-NW¼ of Section 15, Township 95N, Range 11W Chickasaw County, Iowa.  WHEREAS, ON THE 26th, DAY OF APRIL, 2011, at a regular meeting by the Chickasaw County Board of Supervisors, Chickasaw County, Iowa a minor subdivision plat of Parcel B in the N ½ -NW ¼ of Section 15, Township 95N, Range 11W Chickasaw County, Iowa was considered and approved.  WHEREAS, the minor subdivision plat approved on the 26th day of April, 2011 contained a scrivener’s error in that it read, Parcel B in the N ½-NW ¼ of Section 15, Township 91N, Range 12W Chickasaw County, Iowa. The minor subdivision plat should have read Parcel B in the N½-NW¼ of Section 15, Township 95N, Range 11 W Chickasaw County, Iowa.  WHEREAS, the minor subdivision plat of Parcel B in the N½-NW¼  of Section 15, Township 95N, Range 11W Chickasaw County, Iowa has been considered and should be approved.  NOW, THEREFORE, it is hereby resolved by the Chickasaw County, Iowa Board of Supervisors, that said Minor Subdivision Plat be approved, accepted and the Chairman is hereby directed to certify this Resolution of Approval.  PASSED AND APPROVED on this 10th day of May, 2011. /ss/ Virgil M. The Board reviewed the Iowa Department of Human Services Community Mental Health Center Affiliation document.

 

Motion by Byrne, Seconded by Holthaus to approve and authorize Chairman Signature on the Iowa Dept. of Human Services Community Mental Health Center that Chickasaw County will affiliate or contract during Fiscal Year 2012  with Pathways as per Chapter 225C.&(3) of the Code of Iowa to receive MH/MR/DD/BI funding.  Roll Call:  All Ayes. Motion Carried.

 

The Board allowed claims.

 

County Attorney Pat Wegman met with the Board to discuss Exhibit “A” of the Fredericksburg Law Enforcement Contract.  Also present were Assistant County Attorney Mark Huegel, Sheriff Marty Larsen and a member from the media.  Discussion followed.  Pat Wegman reviewed the Equipment Inventory January, 1986 with the Board.

It was the consensus of the Board that the County Attorney send a letter to the City of Fredericksburg attorney in response to Exhibit “A” of the law enforcement contract.

 

The Board received and filed IDNR Manure Management Annual Update for Polk Site 2 (ID# 62989) in Section 15 of Polk Township located at 1301 125th Street, Plainfield, IA 50666.

 

The Board received and filed IDNR Manure Management Annual Update for Prime Feeders, Inc. (ID# 64673) in Section 35 of Jacksonville Township located at 2671 190th Street, New Hampton, IA 50659.

 

Received and place on file Jendro Sanitation Rural Recycling Collection for the month of April, 2011.

  

Motion by Andersen, Seconded by Zoll to adjourn the meeting at Noon.  Roll Call: All Ayes. Motion Carried.
