COUNTY BOARD MINUTES

JULY 29, 2013

 

The Board convened on Monday, July 29, 2013 with all the members present:  Holthaus, Andersen, Byrne, Geerts and Zoll.   The meeting was called to order by Chairman Holthaus. Mail was opened and distributed.  Also present were Assistant County Attorney Mark Huegel, Gene Zimmer as an observer and a member from the media.

 

Motion by Zoll, Seconded by Andersen to approve agenda for July 29, 2013. Roll Call: All Ayes. Motion Carried.

 

Motion by Andersen, Seconded by Byrne to approve board minutes of July 22 & 23, 2013.   Roll Call:  All Ayes.  Motion Carried.

 

Ken Rasing met with the Board to discuss a suggested resolution and letter for the Gary Gorman confinement construction permit. 

 

Motion by Geerts, Seconded by Byrne to approve Resolution for Gary Gorman Confinement Construction Permit.  Roll Call:  All Ayes.  Motion Carried. RESOLUTION NO 7-29-13-21 Chickasaw County Board of Supervisors July 29, 2013

APPROVAL OF WAIVER OF CHICKASAW COUNTY’S RIGHT TO APPEAL ISSUANCE OF FINAL CONSTRUCTION PERMIT FOR THE CONSTRUCTION OF CONFINED ANIMAL FEEDING OPERATION BY THE IOWA DEPARTMENT OF NATURAL RESOURCES.  BE IT RESOLVED by the Chickasaw County Board of Supervisors as follows:  Section 1.  The Chickasaw County Board of Supervisors has received notice from the Department of Natural Resources (DNR) that Gary Gorman has been issued a draft permit for the construction of a confined animal feeding operation building(s) at 2435 180th Street, New Hampton, IA 50659 in unincorporated Chickasaw County.  Section 2.  The Chickasaw County Board of Supervisors reviewed the construction permit application and the manure management plan and determined that both appeared to be in compliance with the requirements of the Master Matrix, Iowa Code Section 459 and Iowa DNR rules and recommended approval of said application on July 2, 2013.  Section 3.  The Chickasaw County Board of Supervisors hereby waives its right to appeal the issuance of the final permit within the fourteen (14) day limit from the time of receipt of notice of the issuance of the draft permit.  Section 4.  The Chickasaw County Board of Supervisors encourages the Iowa DNR to issue the Final Permit immediately upon notification of this waiver.  Section 5.  The Chickasaw County Board of Supervisors authorizes the Board Chairman to notify the Iowa DNR of this waiver.

Section 6.  This resolution shall take effect immediately.  AYES:  /ss/ Rick Holthaus, Steve Geerts, Tim Zoll, John Andersen, Jason Byrne.  NAYS:  None.  ATTEST: /ss/ Joan E. Knoll, Chickasaw County Auditor        

 

Motion by Geerts, Seconded by Andersen to authorize Chairman Signature on the letter to the Iowa Department of Natural Resources to waive the 14 day appeal period for the Gary Gorman confinement construction permit.  Roll Call:  All Ayes.  Motion Carried.

 

Ken Rasing also discussed the upcoming NIMS training.

 

CPC/TCM/GA Director Sheila Kobliska met with the Board to discuss the Request for Proposal (RFP) process for the Heritage Residence and to provide a Targeted Case Management update. 

 

The County Engineer, Dusten Rolando, met with the Board to discuss road departmental activities. Topics included:  maintenance and service of vehicles; maintenance of gravel roads; work orders in various areas; entrance permit; met with FEMA representatives; reviewed inventory; sign repair in Chickasaw, Dayton, Washington townships; Division II contract rock all week; edge rutting on Boyd Blacktop; mowed Larry Busta gravels; sprayed weed in various locations; blades out in various locations; bridge #0950 was removed and substructure; painting bridge rail; Groves bridge finishing up, riprap, dirt moving and seeding; rock gradations in Jacksonville; county line, Winneshiek, waiting to pave; pavement markings-all handwork completed; NIMS training for new employees, etc.

 

Custodian Dave Gorman met with the Board to review quotes for the Courthouse sidewalk repair in front of the Courthouse.  Two quotes were received: Shekleton Concrete Construction, Inc. in the amount of $1300.00 and Jerry Tank Masonry in the amount of $1320.00.  Discussion followed.

 

Motion by Byrne, Seconded by Geerts to accept the quote from Shekleton Concrete Construction, Inc. in the amount of $1300.00 for the Courthouse sidewalk repair.  Roll Call:  Ayes:  Geerts, Andersen, Byrne, Holthaus.  Nays: Zoll. Motion Carried.

 

The Board discussed the artifacts at Munson Park.  Also present was Conservation Director Brian Moore and Conservation Board Member William Raine.  Discussion followed.  It was the consensus of the Board that no action to be taken until after the Board has a chance to review the artifacts at Munson Park scheduled for 1:00 PM.

 

County Attorney Pat Wegman and Assistant County Attorney met with the Board to

Discuss the remaining parcel of the Price Wildlife Property.  The Board stated that there was interest by some residents to purchase the remaining parcel of the Price Wildlife Property.

 

Motion by Byrne, Seconded by Geerts to authorize the County Attorney to prepare the public notice for the sale of the remaining parcel of the Price Wildlife Habitat Property for the Board’s review.  Roll Call:  All Ayes.  Motion Carried.

 

County Attorney Pat Wegman also discussed with the Board the replacement property for the Price Wildlife.  Brian Moore indicated that there were two residents who were interested in selling property to the County.  It was the consensus of the Board that Brian Moore and the county attorney’s office continue the process and continue to update the Board of the progress. 

 

County Attorney Pat Wegman and Assistant County Attorney Mark Huegel discussed and reviewed the Public notice for rent of the Little Wapsi Wildlife Area (aka the Flick Farm) rental property. Brian Moore will research the conservation board minutes regarding the possibility of setting aside some acres for a food plot and Mr. Moore will update the Board of the findings.

 

Motion by Andersen, Seconded by Byrne to enter into contract with Paul Greufe of PJ Greufe & Associates, LLC. as chief negotiator for negotiating the collective bargaining agreements for the Board with the various unions organized in Chickasaw County and authorize Chairman Signature.  Roll Call:  All Ayes.  Motion Carried.

 

The Board allowed claims.

 

The Board received and filed an IDNR Annual Update for 4 Oaks LLC (ID 59728) in Section 32 of Utica Township located at 1830 Ridgeway Blvd., Lawler, IA 52154.

 

The Board recessed at Noon and reconvened about 12:30 PM at Munson Park.  Rick Holthaus, Steve Geerts, and John Andersen were present.  Jason Byrne and Tim Zoll arrived at 12:45 PM.  Other present were Gene Zimmer, observer, William Raine, Chickasaw County Conservation Board member, Brian Moore, Conservation Board Director, and members of Jason Byrne’s family.  Members of the Board and others viewed the contents of the old schoolhouse and the general store.

 

Motion by Andersen, Seconded by Geerts to adjourn the meeting at1:01 PM.  Roll Call: All Ayes. Motion Carried.
