COUNTY BOARD MINUTES

JULY 28 & 29, 2014

 

The Board convened on Monday, July 28, 2014 at 9:30 AM with all members present:

Byrne, Holthaus, Andersen, Geerts, and Zoll.  The meeting was called to order by Chairman Holthaus.  Mail was opened and distributed.    Also present was a member from the media.

 

Motion by Zoll, Seconded by Geerts to approve agenda for July 28 & 29, 2014. Roll Call: All Ayes. Motion Carried.

 

Motion by Andersen, Seconded by Byrne to approve board minutes of July 21 & 22, 2014.   Roll Call:  All Ayes.  Motion Carried.

 

Assessor Doug Welton met with the Board review 2015 Homestead and Military Applications.

Iowa law for the Disabled Veteran’s Homestead Tax Credit as of May 26, 2014 was changed.  The eligibility requirements were expanded to make more veterans eligible.  Any veteran or National Guard member that is considered a veteran by the Code of Iowa and that is receiving benefits from the Veterans Affairs with a service-connected disability rating of 100% is eligible for the credit.  Also a surviving spouse or child that is receiving dependency and indemnity compensation is eligible for the credit, as long as the spouse has not remarried.  The credit is equal to the taxable value of their homestead.  In Chickasaw County fifteen applications for this credit were received, as of July 1, 2014.  Of these Assessor Welton recommended nine for allowance at this time and has withheld his recommendation on five of the applications until after September 2, 2014, the deadline for all paperwork to be turned in for consideration by the Board of Supervisors.  Also Assessor Welton recommended one Military application for disallowance.  The time for all paperwork to be turned in to the Assessor was extended by order of the Director of Revenue of Iowa.

 

Motion by Andersen, Seconded by Byrne to allow the 2014 Homestead and Military Applications as recommended for allowance by the County Assessor and authorize the Chairman to sign.  Roll Call:  All Ayes. Motion Carried.

 

Motion by Byrne, Seconded by Andersen to disallow one 2014 Disabled Veterans Homestead Credit Application and authorize Chairman Signature as recommended by the County Assessor.  Roll Call:  All Ayes. Motion Carried.

 

One applicant was disallowed the 2014 Military Application.

 

Motion by Byrne, Seconded by Geerts to disallow the 2014 Military Application and authorize Chairman Signature due to the application did not meet the requirements and as per recommendation of the County Assessor.  Roll Call:  All Ayes. Motion Carried.

 

Data Processing Manager Doug Welton met with the Board to present paper bids for 40 cases of paper, as follows:  Office World: $36.50 per case  and Riley’s Inc.: $38.15 per case.

 

Motion by Andersen, Seconded by Geerts to approve the bid for the purchase of 40 cases of paper from Office World in the amount of $1460.00 or $36.50 per case.   Roll Call:  All Ayes. Motion Carried.

 

County Engineer Dusten Rolando met with the Board to discuss road departmental activities.   Topics included:  maintenance and service of vehicles; maintenance of gravel roads; work orders in various areas; ditch cleaning and permits in various areas; both new pickups are here, working on getting these pickups ready for service; sign repairs in various areas; mowed lawns outsheds; Division I contract rock almost completed; Division III contract rock; mowed gravel roads; mowed hard surface roads; Division II contract rock; Bridge 3230 all week substructure; erosion control west abutment; poured approach pavements on Usher’s bridge; rock gradations at Boice Quarry; V-48 preliminary plans; break beams and approaches on Usher’s bridge; Division VI contract rocks starts today; FEMA declared in Chickasaw County, etc.

 

Motion by Zoll, Seconded by Geerts to approve permit for Alliant Energy to relocate overhead cable and poles along Cheyenne Avenue and Chickasaw Circle west of Ionia as per recommendation of the County Engineer.  Roll Call:  All Ayes.  Motion Carried.

 

Pat Wegman met with the Board to discuss the Shady Acres mobile home park (South of Town).  Also present was Treasurer Sue Breitbach.  Attorney Wegman informed the Board that Mr. Hoppe had a potential buyers for the 9.51 acres for the mobile home park known as Shady Acres, but the delinquent taxes on the eight mobile homes is in the amount of $11,613.00 needs to be paid. Sue Breitbach gave the Board a breakdown of the Tax Sale Certificates of the eight mobile homes and interest with options.  Discussion followed. 

 

Motion by Geerts, Seconded by Andersen to authorize the County Attorney’s Office to draft or review an agreement between Chickasaw County and Chad Hoppe to pay the amount of $6,165.00 by July 31, 2014 and completely remove all the mobile homes in the Shady Acres mobile home park on or before October 31, 2014.  Roll Call:  All Ayes.  Motion Carried. 

 

Pat Wegman also discussed with the Board the vacancy on the Conservation Board District 2. An individual should be appointed to complete the 2.5 year portion of the five year term.  Discussion followed.  It was the consensus of the Board to advertise for position.  The deadline to file an application in the Auditor’s Office is Friday, August 22, 2014 at 4:30 PM.

 

County Attorney Pat Wegman also discussed the nuisance claim in Chickasaw County.  A complaint from citizens regarding a “goose cannon” that is going off all hours of the night.  Also present was Sheriff Todd Miller, Chief Deputy Marty Hemann, Civil Secretary Barb Hemesath and Assistant County Attorney Mark Huegel.  The Board called Ross Ellingson with IDNR regarding the matter. Mr. Ellingson reported that he has discussed several options with the property owner. One option, Mr. Ellingson suggested was to lessen the frequency the “goose cannon” is fired and/or appropriate times firing for the “goose cannon”.   Mr. Ellingson will contact the property owner and review the options.

 

County Attorney Pat Wegman met with the Board to discuss a litigation matter. Also present was Sheriff Todd Miller, Chief Deputy Marty Hemann, Civil Secretary Barb Hemesath, and Assistant County Attorney Mark Huegel.

 

Motion by Andersen, Seconded by Byrne to enter into closed session under Iowa Code Section 21.5 (1) (c) at Noon as per recommendation of the County Attorney. Roll Call:  All Ayes.  Motion Carried.

 

Discussion followed.

 

Motion by Andersen, Seconded by Geerts to exit closed session at 12:23 PM.  Roll Call:  All Ayes.  Motion Carried.

 

Motion by Geerts, Seconded by Andersen to authorize the County Attorney’s Office to contact Heartland Insurance Risk Pool (HIRP) for assistance on the litigation matter.  Roll Call:  All Ayes.   Motion Carried.

 

Motion by Zoll, Seconded by Geerts to approve the Fireworks permit for Patricia Van Akin.  Roll Call:  All Ayes.  Motion Carried.

 

Motion by Andersen, Seconded by Byrne to adjourn the meeting at 12:25 PM.  Roll Call: All Ayes. Motion Carried.

 

The Board convened on Tuesday, July 29, 2014 at 9:30 AM with all members present:  Geerts, Zoll, Holthaus, Byrne, and Andersen.  The meeting was called to order by Chairman Holthaus. Mail was opened and distributed. Also present was a member from the media.

 

Custodian Dave Gorman met with the Board to discuss and review new carpet for the Community Services Building.

 

Quotes received from Dungey’s Furniture & Floor Coverings in the amount of $6,768.97              and Midwest Floors LLC in the amount of $7,602.77 for new carpet for the public health department and vinyl flooring for the two entry ways.

 

Motion by Zoll, Seconded Byrne to accept the quote from Dungey’s Furniture & Floor Coverings                      in the amount of $6,768.97 for new carpet for the public health department and vinyl flooring for the two entry ways of the Community Services Building.  Roll Call:  All Ayes. Motion Carried.

 

Dave Gorman will contact Northeast Iowa Carpet Cleaning for a quote to clean the carpets in the hallway, Veterans Affairs Office, Star Mentoring, and Conference of the Community Services Building after the installation of the new carpet and vinyl flooring.

 

Dave Gorman will continue contacting vendors for sandblasting the jail cells at the jail building.

 

CPC/TCM/GA Director Sheila Kobliska met with the Board to review the contract with Mercy Medical Center for Substance Abuse services.  Also present was Assistant County Attorney Mark Huegel.  The County Attorney’s office reviewed the contract and presented to the Board some concerns with the contract.  It was the consensus of the Board to have the County Attorney’s Office address the concerns and update the Board next week.

 

Sheila Kobliska is planning HIPAA training for one hour for all department heads on August 13, 2014.  Also Sheila Kobliska would like to establish a HIPAA committee that would develop policies and procedures.  It would consist of a representative from the Board of Supervisors, Data Processing Manager, representative from Auditor’s office, HIPAA Compliance Officer, and a representative from the County Attorney’s office.

 

Sheila Kobliska gave a departmental update on County Social Services (CSS) and Targeted Case Management (TCM) services.   Targeted Case Management is in a transitional phase and is likely to come under the organizational “umbrella” of CSS.  The CSS is developing an organizational chart and more changes in the future.

 

The Board allowed claims.

 

The Board received and filed a short form annual updates for Mark Bruening, Harry Buhre Jr, John Reis, Ron Reis (ID# 60444) in Section 10 of Jacksonville Township located at 2504 140th Street, New Hampton, IA 50659.
