COUNTY BOARD MINUTES

OCTOBER 27 & 28, 2014

 

The Board convened on Monday, October 27, 2014 at 9:30 AM with all members present:

Byrne, Holthaus, Andersen, Geerts, and Zoll.  The meeting was called to order by Chairman Holthaus.  Mail was opened and distributed.    Also present was a member from the media.

 

Motion by Byrne, Seconded by Geerts to approve agenda for October 27 & 28, 2014. Roll Call: All Ayes. Motion Carried.

 

Motion by Andersen, Seconded by Zoll to approve board minutes of October 20-22, 2014.   Roll Call:  All Ayes.  Motion Carried.

 

Custodian Dave Gorman met with the Board to discuss ventilation for the Public Health & Home Care Services Supply Room at the Community Services Building.  Also present was Kathy Babcock.  First, Dave Gorman informed the Board that the installation of the new carpet is now complete.  Next, he reported also that the supply room in question gets too hot probably because of the computer equipment and the two refrigerators that are operating in the supply room and the fact that air does not circulate well enough.  He reported that reorganizing the room has helped the air circulation, but it is still too hot (90 degrees plus sometimes) in the room and so he is looking at other options.  Discussion followed.  Supervisor Geerts will research the project and update the Board of his findings at next Board meeting

 

Dave Gorman also discussed with the Board the air conditioning unit at the Jail Building.  Discussion followed.  It was the consensus of the Board that Dave Gorman get a quote for the economizer from Geerts Plumbing & Heating, Inc. and the Board deferred action until the next meeting.

 

County Engineer Dusten Rolando met with the Board to discuss road departmental activities.   Topics included:  maintenance and service of vehicles; maintenance of gravel roads; entrance permits in various areas; ditch cleaning permits; side road culvert work and V-48-250th St.; chloride delivered; sign inventory; opening and closing roads on V-48; edge rutting on Jericho road; motorgraders blading gravels; spot rock various locations; bridge repair list review; survey work; bridge review, project repairs; final plans on V-48 white topping; final plans pavement markings; equipment operator interviews, union negotiations etc.

 

County Attorney Pat Wegman met with the Board for a Sheriff’s Office personnel update.

 

Chief Deputy Marty Hemann met with the Board to discuss FY 16 Communication Services.   Also present was County Attorney Pat Wegman.  Discussion followed.

 

Motion by Geerts, Seconded by Zoll to approve the resolution to correct the title of Resolution 10-21-14-34 by deletion of Dewdrop Farms, LLC to Chickasaw County’s right to appeal the issuance of the final construction permit by the Iowa Department of Natural Resources for Dewdrop Farms, LLC for the construction of the confined animal feeding operation as requested by Dewdrop Farms, LLC and authorize Chairman Signature.  Roll Call:  All Ayes.  Motion Carried.  RESOLUTION NO. 10-27-14-35 CORRECTION OF TITLE OF RESOLUTION 10-21-14-34 BY DELETION OF DEWDROP FARMS, LLC TO CHICKASAW COUNTY CHICKASAW COUNTY BOARD OF SUPERVISORS OCTOBER 27, 2014

APPROVAL OF WAIVER OF CHICKASAW COUNTY’S RIGHT TO APPEAL ISSUANCE OF FINAL CONSTRUCTION PERMIT FOR THE CONSTRUCTION OF CONFINED ANIMAL FEEDING OPERATION BY THE IOWA DEPARTMENT OF NATURAL RESOURCES.  BE IT RESOLVED by the Chickasaw County Board of Supervisors as follows:

Section 1.  The Chickasaw County Board of Supervisors has received notice from the Iowa Department of Natural Resources (DNR) that Dewdrop Farms, LLC has been issued a draft permit for the construction of a confined animal feeding operation building(s) in Section 25-T97N-R13W, Washington Township, in unincorporated Chickasaw County.  Section 2.  The Chickasaw County Board of Supervisors reviewed the construction permit application and the manure management plan and determined that both appeared to be in compliance with the requirements of the Master Matrix, Iowa Code Section 459 and Iowa DNR rules and recommended approval of said application on September 22, 2014.  Section 3.  The Chickasaw County Board of Supervisors hereby waives its right to appeal the issuance of the final permit within the fourteen (14) day limit form the time of receipt of notice of the issuance of the draft permit.  Section 4.  The Chickasaw County Board of Supervisors encourages the Iowa DNR to issue the Final Permit immediately upon notification of this waiver.  Section 5.  The Chickasaw County Board of Supervisors authorizes the Board Chairman to notify the Iowa DNR of this waiver.  Section 6.  This resolution shall take effect immediately.  /ss/ Rick Holthaus, Chairman Board of Supervisors ATTEST: /ss/Joan E. Supervisor Holthaus updated the Board on the Heartland Meeting and the Northeast Iowa Community Action meeting.

 

The Board recessed at 11:30 AM and reconvened at 1:00 PM.

 

The Board held a strategic planning session regarding law enforcement and related areas at Law & Emergency Management Center.  Present were Supervisors Andersen, Byrne, Zoll, Geerts and Holthaus, Auditor Joan E. Knoll, Sheriff Todd Miller, Chief Deputy Marty Hemann, County Attorney Pat Wegman, Assistant County Attorney Mark Huegel, Ken Rasing and a member from the media.  Discussion followed. 

 

Chairman Holthaus declared adjournment at 2:30 PM.

 

The Board convened on Tuesday, October 28, 2014 at 9:30 AM with the following members present:  Zoll, Holthaus, Byrne, and Andersen.  Absent: Geerts.   The meeting was called to order by Chairman Holthaus. Mail was opened and distributed.   Also present was a member from the media.

 

Conservation Director Brian Moore met with the Board for a departmental update.  Also present was Assistant County Attorney Mark Huegel.

 

Mr. Moore also informed the Board that new signs were installed on the Louie Hugh property, Justin and Saude property.   Brian Moore informed the Board that CVT completed the soil test to accommodate a leachate field and dump station at Airport Lake.  Mr. Moore informed the Board

that the agreement between Chickasaw County and Mr. Hanawalt was signed to remove fallen timber at Jenn Timber property. Mr. Moore also informed the Board that the Conservation Board is looking at a “Host Camper” for the Split Rock Park and also increasing the camping rates.   Brian Moore informed the Board that the Conservation Board Member District 5 position expires December 31, 2014 and has been advertised in the New Hampton Papers and Fredericksburg Review. 

 

Motion by Andersen, Seconded by Byrne to authorize the purchase of an economizer to make it more efficient from Geerts Plumbing & Heating, Inc. in the amount of $850.00 and installation in the amount of $250.00 for a total cost of $1,100.00 for the jail building.  Roll Call:  All Ayes.  Motion Carried.

Land Use Administrator Staci Schutte met with the Board for approval of two minor subdivisions.

 

Motion by Zoll, Seconded by Andersen to approve and authorize Chairman Signature on the Resolution for the minor subdivision for Larry Bruening and Matthew Bruening as per recommendation of the Land Use Administrator.  Roll Call:  All Ayes.  Motion Carried.  RESOLUTION 10-28-14-36.  A RESOLUTION APPROVING THE LAND DIVISION OF parcel H in Parcel E in the EAST HALF of the SOUTHWEST Quarter of Section 28, Township 96 NORTH, Range 12 WEST OF THE 5TH P.M., Chickasaw County, Iowa.  WHEREAS, ON THE 28th DAY of OCTOBER 2014 at a regular meeting by the Board of Supervisors, Chickasaw County, Iowa, the land division of Parcel H in Parcel E in the East Half of the Southwest Quarter of Section 28, Township 96 North, Range 12 West of the 5th P.M., Chickasaw County, Iowa was presented.  WHEREAS, the land division of Parcel H in Parcel E in the East Half of the Southwest Quarter of Section 28, Township 96 North, Range 12 West of the 5th P.M., Chickasaw County, Iowa has been considered and should be approved. NOW, THEREFORE, it is hereby resolved by the Board of Supervisors, Chickasaw County, Iowa that said land division shall be approved, accepted and the Chairman is hereby directed to certify this Resolution of Approval.  PASSED AND APPROVED on this 28th DAY of OCTOBER 2014. /ss/ Rick Holthaus, Chairman, Board of Supervisors ATTEST: /ss/ Joan E. Motion by Byrne, Seconded by Andersen to approve and authorize Chairman Signature on the Resolution for the minor subdivision for Larry Bruening and Matthew Bruening as per recommendation of the Land Use Administrator.  Roll Call:  All Ayes.  Motion Carried.  RESOLUTION 10-28-14-37.   A RESOLUTION APPROVING THE MINOR SUBDIVISION PLAT OF ParcelS I  and J in the EAST HALF of the SOUTHwest Quarter of Section 28, Township 96 NORTH, Range 12 WEST OF THE 5TH P.M., Chickasaw County, Iowa.              WHEREAS, ON THE 28th DAY of OCTOBER 2014 at a regular meeting by the Board of Supervisors, Chickasaw County, Iowa a minor subdivision plat of  Parcels I and J  in the East Half of the Southwest Quarter of Section 28, Township 96 North, Range 12 West of the 5th P.M., Chickasaw County, Iowa was presented.  WHEREAS, the minor subdivision plat of  Parcels I and J  in the East Half of the Southwest Quarter of Section 28, Township 96 North, Range 12 West of the 5th P.M., Chickasaw County, Iowa has been considered and should be approved. NOW, THEREFORE, it is hereby resolved by the Board of Supervisors, Chickasaw County, Iowa that said Minor Subdivision Plat be approved, accepted and the Chairman is hereby directed to certify this Resolution of Approval.  PASSED AND APPROVED on this 28th DAY of OCTOBER 2014.
