COUNTY BOARD MINUTES

MAY 25 & 26, 2015

 

The Courthouse and offices were closed on Monday, May 25, 2015 in observance of the Memorial Day Holiday.

 

The Board convened on Tuesday, May 26, 2015 at 9:30 AM with all members present:  Geerts, Carolan, Holthaus, Andersen, and Zoll.  The meeting was called to order by Chairman Holthaus.   Mail was opened and distributed.  Also present was a member from the media.

 

Motion by Geerts, Seconded by Andersen to approve agenda for May 25 & 26, 2015.   Roll Call:   All Ayes:  Motion Carried.

 

Motion by Andersen, Seconded by Carolan to approve board minutes of May 18 & 19, 2015.   Roll Call:  All Ayes.  Motion Carried.

 

Present for the hearing were Ken Rasing on behalf of the County, Mark Kipp and Haley Pagel with Jerico Construction, Staci Schutte, Dan Feenstra, Frank Moore, Emmett Meissen, Marianne Meissen, James Frantzen, Amanda Luna, Gene Noem, Nick Feenstra, Kathy Meissen, Tom Frantzen, Irene Frantzen, and a member from the media.

 

Motion by Andersen, Seconded by Carolan to open the public hearing at 9:32 AM regarding the DNR Construction Permit Application and Master Matrix for the Aquamarinebrook, LLC-Menges Site in Section 34 of Washington Township.  Roll Call:  All Ayes.  Motion Carried.

 

Oral Comments were made by various members from the public regarding a variety of concerns that included those having to do with the odors that could be anticipated as coming from the facility and their effects on property values and the quality of life for the neighbors of this facility; the absence of the owner of the planned facility at the public hearing; the effects of the increased heavy traffic on the road infrastructure; the existence of two embargoed bridges necessary to gain access to the property and how the owner would deal with the need to respect the weight limits imposed by the embargoes both to first construct the facility and then on an ongoing basis; the nearness of the planned facility to the floodplain and the history of high flood water in that part of the county; water level of the aquifers and the potential contamination of the drinking waters; the waste management plan and how that would be executed.  The person responsible for the construction of the facility responded to concerns expressed to him.

 

Oral and Written comments from the public were received and filed in the Auditorís Office.  Irene Frantzen shared a letter, Tom Frantzen shared a letter, and James Frantzen shared a quote from Dick Thompson, the co-founder of Practical Farmers of Iowa. Also filed was a petition (approx. 58 signatures) in opposition of the hog confinement facility

 

Ken Rasing reviewed the master matrix and points assigned, along with site review by the DNR and affirmed a total matrix score of 460 points.  Discussion followed. 

 

Motion by Andersen, Seconded by Geerts to close the public hearing at 10:41AM.  Roll Call:  All Ayes. Motion Carried.

 

Motion by Andersen, Seconded by Geerts to approve the master matrix scoring and recommend the approval of the DNR Construction Permit Application for the Aquamarinebrook, LLC-Menges Site in Section 34 of Washington Township located at 1271 Jasper Avenue as per the recommendation of Environmental Health Director.  Roll Call:  All Ayes.  Motion Carried.  

 

Ken Rasing met with the Board to discuss additional members to the Courthouse Security Committee as per the Guidelines Courthouse and Public Building Security in Iowa. 

 

Motion by Geerts, Seconded by Andersen to appoint a representative from the Juvenile Court Service and the County Attorney as per the Guidelines for Courthouse and Public Building Security in Iowa.  Roll Call:  All Ayes.  Motion Carried.

 

Ken Rasing also asked the Board for a request letter to the Northeast Iowa Response Group (NIRG) for the Haz Mat Trailer for the Chickasaw County Fire Association Meeting.  

Motion by Carolan, Seconded by Geerts to authorize Chairman Signature on a Request Letter to Northeast Iowa Response Group (NIRG) for the Haz Mat Trailer for the Chickasaw County Fire Association Meeting scheduled Monday, August 24, 2015 at 7:00 PM at the Rescue Squad Building.  Roll Call:  All Ayes.  Motion Carried.

 

Motion by Geerts, Seconded by Carolan to approve Fireworks Permit for New Hampton Kenwood Avenue Park, Inc.  Roll Call:  All Ayes.  Motion Carried.

 

Land Use Administrator Staci Schutte met with the Board for the approval of four minor subdivisions.

 

Motion by Geerts, Seconded by Andersen to approve and authorize Chairman Signature on the Resolution for the minor subdivision for Alice Rethamel as per the recommendation of the Land Use Administrator.  Roll Call:  All Ayes.  Motion Carried.  RESOLUTION 5-26-15-14 A RESOLUTION APPROVING THE MINOR SUBDIVISION PLAT OF  parcel bb in the Northeast quarter of the northeast quarter of section 10, Township 95 NORTH, Range 12 WEST OF THE 5TH P.M., Chickasaw County, Iowa. WHEREAS, ON THE 26th DAY of MAY at a regular meeting by the Board of Supervisors, Chickasaw County, Iowa a minor subdivision plat of Parcel BB in the Northeast Quarter of the Northeast Quarter of Section 10, Township 95 North, Range 12 West of the 5th P.M., Chickasaw County, Iowa was presented.  WHEREAS, the minor subdivision plat of Parcel BB in the Northeast Quarter of the Northeast Quarter of Section 10, Township 95 North, Range 12 West of the 5th P.M., Chickasaw County, Iowa has been considered and should be approved.  NOW, THEREFORE, it is hereby resolved by the Board of Supervisors, Chickasaw County, Iowa that said Minor Subdivision Plat be approved, accepted and the Chairman is hereby directed to certify this Resolution of Approval.  PASSED AND APPROVED on this 26th DAY of MAY 2015.  /ss/ Rick Holthaus, Chairman, Board of Supervisors.  ATTEST: /ss/ Joan E. Motion by Zoll, Seconded by Carolan to approve and authorize Chairman Signature on the Resolution for the minor subdivision for Florentine Huegel as per the recommendation of the Land Use Administrator.  Roll Call:  All Ayes.  Motion Carried.  RESOLUTION 5-26-15-15 A RESOLUTION APPROVING THE MINOR SUBDIVISION PLAT OF  parcel C in the south half of the southwest quarter of section 2, Township 95 NORTH, Range 14 WEST OF THE 5TH P.M., Chickasaw County, Iowa.  WHEREAS, ON THE 26th DAY of MAY at a regular meeting by the Board of Supervisors, Chickasaw County, Iowa a minor subdivision plat of Parcel C in the South Half of the Southwest Quarter of Section 2, Township 95 North , Range 14  West of the 5th P.M., Chickasaw County, Iowa was presented.  WHEREAS, the minor subdivision plat of Parcel C in the South Half of the Southwest Quarter of Section 2, Township 95 North , Range 14  West of the 5th P.M., Chickasaw County, Iowa has been considered and should be approved.  NOW, THEREFORE, it is hereby resolved by the Board of Supervisors, Chickasaw County, Iowa that said Minor Subdivision Plat be approved, accepted and the Chairman is hereby directed to certify this Resolution of Approval.  PASSED AND APPROVED on this 26th DAY of MAY 2015.  /ss/ Rick Holthaus, Chairman, Board of Supervisors.  ATTEST: /ss/ Joan E. Njus as per the recommendation of the Land Use Administrator.  Roll Call:  All Ayes.  Motion Carried.  RESOLUTION 5-26-15-15 A RESOLUTION APPROVING THE MINOR SUBDIVISION PLAT OF  parcel C in the south half of the southwest quarter of section 2, Township 95 NORTH, Range 14 WEST OF THE 5TH P.M., Chickasaw County, Iowa.  WHEREAS, ON THE 26th DAY of MAY at a regular meeting by the Board of Supervisors, Chickasaw County, Iowa a minor subdivision plat of Parcel C in the South Half of the Southwest Quarter of Section 2, Township 95 North , Range 14  West of the 5th P.M., Chickasaw County, Iowa was presented.  WHEREAS, the minor subdivision plat of Parcel C in the South Half of the Southwest Quarter of Section 2, Township 95 North , Range 14  West of the 5th P.M., Chickasaw County, Iowa has been considered and should be approved.           NOW, THEREFORE, it is hereby resolved by the Board of Supervisors, Chickasaw County, Iowa that said Minor Subdivision Plat be approved, accepted and the Chairman is hereby directed to certify this Resolution of Approval.  PASSED AND APPROVED on this 26th DAY of MAY 2015.

Motion by Geerts, Seconded by Zoll to approve and authorize Chairman Signature on the Resolution for the minor subdivision for Terry L. Stone, Richard Stone, and Standard S. Stone as per the recommendation of the Land Use Administrator.  Roll Call:  All Ayes.  Motion Carried.   RESOLUTION 5-26-15-17 A RESOLUTION APPROVING THE MINOR SUBDIVISION PLAT OF PARCELS I, J and K in the southwest

quarter of section 20, Township 97 NORTH, Range 13 WEST OF THE 5TH P.M., Chickasaw County, Iowa.  WHEREAS, ON THE 26th DAY of MAY at a regular meeting by the Board of Supervisors, Chickasaw County, Iowa a minor subdivision plat of  Parcel I, J and K in the Southwest Quarter of Section 20, Township 97 North, Range 13 West of the 5th P.M., Chickasaw County, Iowa was presented.  WHEREAS, the minor subdivision plat of Parcel I, J and K in the Southwest Quarter of Section 20, Township 97 North, Range 13 West of the 5th P.M., Chickasaw County, Iowa has been considered and should be approved.           NOW, THEREFORE, it is hereby resolved by the Board of Supervisors, Chickasaw County, Iowa that said Minor Subdivision Plat be approved, accepted and the Chairman is hereby directed to certify this Resolution of Approval.  PASSED AND APPROVED on this 26th DAY of MAY 2015.

The Board discussed the letter from the Buchanan County Conservation Board regarding their request that participants of the Wapsipinicon River Watershed Authority combine efforts to develop a comprehensive plan for the Wapsipinicon River Watershed Authority, and implement the plan to improve water quality and reduce flooding.  The first step is to collect data about water quality by monitoring water in the Wapsipinicon River and its tributaries.  Supervisor Andersen will contact the Conservation Director Brian Moore for additional information and update the Board at a later date.

 

It was the consensus of the Board to discuss the Chickasaw County Tourism Agreement at the next meeting.

Received and filed in the Auditorís Office a short form for annual updates for Northwood Creek LLC-Braniger Site (ID# 65751) in Section 8 of Utica Township located at 1447 Stevens Avenue, Lawler, IA 52154.
