COUNTY BOARD MINUTES

JULY 27 & 28, 2015

 

The Board convened on Monday, July 27, 2015 at 9:30 AM with the following members present:  Geerts, Holthaus, Andersen, and Zoll.   Absent: Carolan attending another meeting. The meeting was called to order by Chairman Holthaus.   Mail was opened and distributed.  

 

Motion by Geerts, Seconded by Andersen to approve agenda for July 27 & 28, 2015 with the cancellation of the 9:30 AM appointment.   Roll Call:  Ayes: Geerts, Zoll, Andersen, and Holthaus.  Absent:  Carolan.    Motion Carried.

 

Motion by Zoll, Seconded by Geerts to approve the Fireworks Permit for Angela Margrich.

Roll Call:  Ayes: Geerts, Zoll, Andersen, and Holthaus.  Absent:  Carolan.    Motion Carried.

Motion by Zoll, Seconded by Andersen to approve board minutes of July 20 & 21, 2015.   Roll Call:  All Ayes.  Motion Carried.

 

The Board reviewed the Letter of Understanding for services provided by Hacker, Nelson & Co., PC for the FY 2014-2015 audit.

 

Motion by Geerts, Seconded by Zoll to approve and authorize Chairman Signature on the Letter of Understanding for services provided by Hacker, Nelson & Co.,  PC for FY 2014-2015 audit.  Roll Call:  All Ayes.  Motion Carried.

 

County Attorney Pat Wegman and Assistant County Attorney Mark Huegel met with the Board to discuss Shady Acres Mobile Home Park. Also present was Treasurer Sue Breitbach.  Supervisor Holthaus informed the Board that Mr. Hoppe had a potential buyer for the 9.51 acres for the mobile home park known as Shady Acres.  Discussion followed.   The County Attorney’s office will contact the owner of the property regarding the clean-up process and update the Board on the progress of the clean-up.

 

Motion by Geerts, Seconded by Andersen to approve Resolution for abatement of mobile home taxes under the name of Shady Acres.  Roll Call:  All Ayes.  Motion Carried.  RESOLUTON NO. 7-27-15-34 FOR ABATEMENT OF MOBILE HOME TAXES WHEREAS, THERE ARE UNPAID MOBILE HOME TAXES UNDER THE NAME OF Shady Acres.  According to Iowa Code Section 435.25 and 445.16, the County Treasurer may recommend tax abatement to the Board of Supervisors.  On July 27, 2015, Treasurer Sue Breitbach recommended the Board of Supervisors abate all delinquent taxes on the following mobile homes:  1977 Schult mobile home, Title #19W101474, VIN# 158491, owner Shady Acres, abate the taxes for the years 2011, 2012, 2013, and 2015 in the amount of $600.00. 1980 Fairpoint mobile home, Title #19W101476, VIN# 27122, owner Shady Acres, abate ht taxes for the years 2011, 2012, 2013, and 2015, in the amount of #592.00.  1982 Marshfield Doral mobile home, Title #19W101479, VIN# 45112, owners Shady Acres, abate the taxes for the years 2011, 2012, 2013, and 2015 in the amount of

$672.00. 1977 Artcraft mobile home, Title#19W101482, VIN#AP9653, owner Shady Acres, abate the taxes for the years 2011, 2012, 2013, and 2015 in the amount of $592.00. 1971 Marshfield mobile home, Title#19W101478, VIN#C452, owner Shady Acres, abate the taxes for the years 2011, 2012, 2013 and 2015 in the amount of $736.00.  1976 Artcraft mobile home, Title #19W101483, VIN#Cl7873, owner Shady Acres, abate the taxes for the years 2011, 2012, 2013 and 2015 in the amount of $584.00.  1978 Holly Park mobile home, Title #19W101481, VIN#M605170, owner Shady Acres, abate the taxes for the years 2011, 2012, 2013, and 2015 in the amount of $592.00.  1974 Wickcraft mobile home, Title # 19W101475, VIN#SM2421, owner Shady Acres, abate the taxes for the years 2011, 2012, 2013 and 2015 in the amount of $592.00.  The above mobile homes were located in the Shady Acres Mobile Home Court, 2300 S Linn Ave., New Hampton, IA.  NOW, THEREFORE BE IT RESOLVED, THIS Board is in agreement by their motion on July 27, 2015, and therefore will abate all taxes due. Jim Cook met with the Board to introduce himself and to discuss the Continuity of Operations Plan (COOP) for Chickasaw County.  Mr. Cook is doing an internship through Ken Rasing Office.  Mr. Cook informed the Board that he is collecting data from the various departments for the plan and hopes to have the plan completed within the next couple of months for the Board’s approval.

 

Assistant County Attorney Mark Huegel and Deputy Assessor Ray Armel met with the Board to discuss the resolution and notice of abandonment and sale of property owned by Chickasaw County and set the public hearing.  Also present was Leitha Springer.  Mark Huegel informed the Board that letters were sent to the three adjoining landowners June 15, 2015 and to respond by July 17, 2015 if the landowner was interested in the property. Mr. Huegel informed the Board that all three landowners were interested in the property.   The Board of Supervisor has scheduled a public hearing on the property for August 17, 2015 at 11:00 AM as set forth in the Resolution.

Mr. Huegel informed the Board that the County Attorney’s Office will send a letter to the three adjoining landowners regarding the public hearing and the auction process after the public hearing.

 

Motion by Zoll, Seconded by Carolan to approve Resolution to set public hearing for the abandonment and Sale of a parcel in the SE¼ of the SW¼ of Section 9-94-14.  Roll Call:  All Ayes. Motion Carried.  RESOLUTION NO. 7-27-15-33 A RESOLUTION SETTING FORTH THE CHICKASAW COUNTY BOARD OF SUPERVISORS INTENT TO SELL AND ABANDON A STRIP OF LAND SIXTY SIX (66) FEET BY THREE HUNDRED THIRTY (330) FEET LEGALLY DESCRIBED AS:  WEST FOUR (4) RODS, EAST TWENTY EIGHT (28) RODS, SOUTH TWENTY (20) RODS, OF THE SOUTHEAST OF THE SOUTHWEST, SECTION NINE (9), TOWNSHIP NINETY-FOUR (94), RANGE FOURTEEN (14). WHEREAS, Chickasaw County owns a strip of land sixty six (66) feet by three hundred thirty (330) feet, legally described as:  West Four (4) Rods, East Twenty Eight (28) Rods, South Twenty (20) Rods, of the Southeast of the Southwest, Section Nine (9), Township Ninety-Four (94), Range Fourteen (14), and WHEREAS, the said property described herein above is landlocked and there is no easement for ingress or egress. WHEREAS, the Board of Supervisors of Chickasaw County, Iowa, has determined that the continued ownership of the above described real estate is a detriment to the citizens of Chickasaw County, Iowa, and

WHEREAS, the Board of Supervisors of Chickasaw County, Iowa, has determined that it is in the best interests of the citizens of Chickasaw County, Iowa, that the real estate described herein above be abandoned by Chickasaw County for the purpose of sale, and WHEREAS, the adjacent land owners have the only ingress and egress access to the above described property. WHEREAS, the adjacent land owners have expressed a written interest in acquiring the property, and WHEREAS, it is in the best interest of Chickasaw County, Iowa, to sell the real estate described as follows:  West Four (4) Rods, East Twenty Eight (28) Rods, South Twenty (20) Rods, of the Southeast of the Southwest, Section Nine (9), Township Ninety-four (94), Range Fourteen (14).   NOW, THEREFORE, BE IT HEREBY RESOLVED by the Chickasaw County Board of Supervisors of Chickasaw County, Iowa: 1.  The best interests of Chickasaw County, Iowa, and the citizens thereof require that formal action be taken for the abandonment and sale of A strip of land sixty six (66) feet by three hundred thirty (330) feet in width, legally described as:  West Four (4) Rods, East Twenty Eight (28) Rods, South Twenty (20) Rods, of the Southeast of the Southwest, Section Nine (9), Township Ninety-Four (94), Range Fourteen (14). 2.  That the sale of said property described in paragraph 1 above, be completed with the sale of said property immediately after a public hearing by auction to those people that have expressed a written interest in purchasing the same property. 3. Deputy Assessor Ray Armel met with the Board review 2015 Homestead and Military Applications.   The law for the Disabled Veteran’s Homestead Tax Credit as of May 26, 2014 was changed.  The law was amended with new legislation during the 2015 legislature.  The changes made will affect some veterans that had been approved last year.  The word PERMANENT was added to the language of the law, so veterans or any National Guard member that is considered a veteran by the Code of Iowa with a permanent service connected disability rating of 100 percent will qualify.  Before the veteran did not need to have a permanent disability, only need to have a rating of 100 percent service connected disability.  The law also includes veterans or any National Guard member that is considered a veteran by the Code of Iowa, that may not have a 100 percent permanent service connected disability, but are paid based on an individual unemployability rating of 100 percent because of the disability.  The changes to the law were made retroactive to May 26, 2014.  The signing deadline was also amended to allow a veteran that did not apply, because the veteran did not meet the requirements, but do meet them as amended, to be able to apply for the 2014 year.  Also a surviving spouse or child that is receiving dependency and indemnity compensation is eligible, as long as the spouse has not remarried.  This part of the law was not changed.  The credit is equal to the taxable value of their homestead, with a maximum land amount of forty acres in rural areas an one half acre in towns.  In Chickasaw County we have received, as of July 1, 2015, a total of eleven new applications for the credit, of them five will qualify for 2014 and then nine applications for 2015.  The Assessor’s office has  recommended nine of these for allowance at this time.

 

Motion by Andersen, Seconded by Carolan to allow nine 2015 Disabled Veterans Homestead Tax Credit Applications and authorize Chairman Signature as per recommendation of the County Assessor’s Office.  Roll Call:  All Ayes.  Motion Carried.

 

Motion by Andersen, Seconded by Zoll to disallow two 2015 Disabled Veterans Homestead Credit Application and authorize Chairman Signature as per recommendation of the County Assessor’s Office.  Roll Call:  All Ayes. Motion Carried.

 

One applicant was disallowed the 2015 Military Tax Credit Exemption Application

 

Motion by Andersen, Seconded by Geerts to disallow the 2015 Military Tax Credit Exemption Application and authorize Chairman Signature as per recommendation of the County Assessor’s Office.  Roll Call:  All Ayes. Motion Carried.

 

Four applicants were disallowed the 2015 Homestead Tax Credit Applications.

 

Motion by Geerts, Seconded by Andersen to disallow the 2015 Homestead Tax Credit Application and authorize Chairman Signature as per the recommendation of the County Assessor.  Roll Call:  All Ayes.  Motion Carried.

 

Motion by Andersen, Seconded by Carolan to allow the 2015 Homestead Tax and Military Tax Exemption Applications and authorize Chairman Signature as per the recommendation of the County Assessor’s Office.  Roll Call:  All Ayes. Motion Carried.

 

The County Engineer Dusten Rolando met with the Board to discuss road departmental activities.  Topics included:  maintenance and service of vehicles; maintenance of gravel; work order, various areas, V-48; entrance permits, various areas; grinding bumps, Nashua; reviewed inventory; mowed lawns at shops; set detour for T-76 bridge overlay; removed V-48 detour signs; Division 1 contract rock; Division II contract rock; spot rocking in various areas; mowed hard surface roads; mowed gravel roads; SC2180 box culvert; 170th street box culvert started, BR 2630; t-76 Bridge overlay continues; Jackson Quarry rock sample, gradation; V-48 finalization paperwork, etc.

 

Motion by Zoll, Seconded by Carolan to approve the permit for Butler County REC to relocate an existing overhead electric line in the county right of way in the SW1/4 of Section 32, Chickasaw Township as per the recommendation of the County Engineer.  Roll Call:  All Ayes.  Motion Carried.

 

Motion by Carolan, Seconded by Geerts to approve the permit for Butler County REC to place underground cable in the county right row way along Stanley Avenue south of Hwy 18 in Section 18, Fredericksburg Township as per the recommendation of the County Engineer.  Roll Call:  All Ayes.  Motion Carried.

 

Motion by Zoll, Seconded by Andersen to approve the permit for Hawkeye REC to place buried cable in the county right of way along Jasper Avenue in Section 27, Washington Township South as per the recommendation of the County Engineer.  Roll Call:  All Ayes.  Motion Carried.

 

Motion by Andersen, Seconded by Geerts to approve the permit for Hawkeye REC to place overhead wires and poles along 190th Street West of Gilmore Avenue in Section 6, Dayton Township and Section 31, Washington Township South as per the recommendation of the County Engineer.  Roll Call:  All Ayes.  Motion Carried.

 

The Board reviewed the Open Records Policy.  The Board deferred action until the next meeting.

 

Received and filed in the Auditor’s Office received a MMP Short Form for Annual Updates for Russell L. Schelkopf Trust  #101-Eickhoff Site (ID# 58112 in Section 31 of Eden Township located at 25820 X Avenue, Waucoma, IA 52171.

 

Received and filed in the Auditor’s Office received a MMP Short Form for Annual Updates for Mike Reicks (ID# 64781) in Section 33 of Utica Township located at 3052 180th Street, Lawler, IA 52154.

 

Motion by Geerts, Seconded by Andersen to adjourn the meeting at 12:55 PM.  Roll Call: All Ayes. Motion Carried.

 

The Board convened on Tuesday, July 28, 2015 at 9:30 AM with all members present:  Geerts, Holthaus, Carolan, Zoll, and Andersen.  The meeting was called to order by Chairman Holthaus. Mail was opened and distributed.  Also present was a member from the media.

 

Custodian Dave Gorman met with the Board to discuss the parking lot at the Community Services Building.

 

The Board received and opened three bids.  Discussion followed.  The Board tabled all bids until Dave Gorman gathers more information from the vendors. 

 

Motion by Carolan, Seconded by Geerts to approve fireworks permit for Brett and Lavonne Ohm.

Roll Call:  All Ayes.  Motion Carried.

 

Motion by Andersen, Seconded by Geerts to approve fireworks permit for Jessica Steinlage.  Roll Call:  All Ayes.  Motion Carried.

 

Representatives Mike Thompson and Brenda Janvrin with America’s Best Cleaning and Restoration Services, Rochester, MN met with the Board to discuss the showers in the Jail Building and the Air Quality Report.   Also present were Custodian Dave Gorman, Sheriff Todd Miller and Chief Deputy Marty Hemann.  Mr. Thompson reviewed and discussed with the Board the process of the clean-up and sealing process, the epoxy procedures to the floors and the proposal. Discussion followed.  America’s Best Cleaning and Restoration Services will submit a proposal that will include the sandblasting of the two showers for the Board’s review.

 

Supervisor Andersen reviewed the Open Records Policy with the Board.  Mr. Andersen informed the Board that the County Attorney’s Office reviewed the policy. 

 

Motion by Andersen, Seconded by Carolan to adopt the Open Records Policy as presented.  Roll Call:  All Ayes.  Motion Carried.

 

Prairie View Administrator Sylvia Mork, Maintenance Supervisor Dwight Ohrt, Sarah Dungey, and Ken Rasing  met with the Board for an update on the Heritage Residence and to the discuss Phase II grant plan for building improvements at the Heritage Residence.  The Board reviewed the grant plan.  Phase II Grant Plan includes replacing 7 windows in the dining room, kitchen, meeting room and an office, replace air conditioning and heating units that service the kitchen, pantry, office, med room office and activities room.  Ms. Mork informed the Board that the completion date for Phase II of the project is December 31, 2015.  Discussion followed.

 

Motion by Carolan, Seconded by Zoll to cap the county share of the Phase II Grant Plan-Heritage Residence project at $5,000.00 as presented by the Prairie View Management, Inc.  Roll Call:  All Ayes.  Motion Carried.

 

The Board allowed claims.

The Board convened on Thursday, July 30, 2015 at 4:00 PM at the Airport Lake with all members present:  Geerts, Holthaus, Carolan, Zoll, and Andersen.  The meeting was called to order by Chairman Holthaus.   Also in attendance were members of the Chickasaw County Conservation Board Chairman Ray Armbrecht, Tom Soenen, Bill Raine and Lori Carey. Others in attendance included Conservation Board Director Brian Moore, Denise Straw, Chad Humpal, Dennis Steinlage and a member from the media.

 

Those present were invited to view the Airport Lake Shower and Restroom facility that is being constructed. Discussion followed.

 

Supervisor Geerts left at 5:10 PM.

 

Chariman Holthaus declared adjournment at 5:12 PM.
