COUNTY BOARD MINUTES

JANUARY 25, 26, & 27, 2016

 

The Board convened on Monday, January 25, 2016 at 9:30 AM with all members present:  Geerts, Carolan, Holthaus, Andersen, and Zoll.  The meeting was called to order by Chairman Andersen.   Mail was opened and distributed.  Also present was a member from the media.

 

Motion by Holthaus, Seconded by Geerts to approve agenda for January 25, 26, & 27, 2016 with the cancellation of the January 27, 2016 agenda.   Roll Call: All Ayes. Motion Carried.

 

Motion by Zoll, Seconded by Carolan to approve board minutes of January 18 & 19, 2016.   Roll Call:  All Ayes.  Motion Carried.

 

Chief Deputy Sheriff Marty Hemann met with the Board to acknowledge the hiring of a full time dispatcher/ jailer.  Also present Sheriff Todd Miller and Jamie Ekwall.

 

Motion by Geerts, Seconded by Holthaus to acknowledge the hiring of Jamie Ekwall as full time dispatcher/jailer effective January 25, 2016 as per union contract.  Roll Call:  All Ayes.  Motion Carried.

 

Chief Deputy Marty Hemann asked the Board to defer taking action of the purchase of a motor vehicle for the sheriff’s department until the next Board meeting to review the quotes.

Supervisor Holthaus gave the Board an update on the Heartland Insurance Risk Pool meeting held on Thursday, January 21, 2016.

 

The County Engineer Dusten Rolando met with the Board to discuss road departmental activities.  Topics included:  maintenance and service of vehicles; maintenance of gravel roads; 1-18-16 motorgraders hitting drift areas; brushing in various areas all week; motorgraders scraping in various locations, all week; 5-one ways out at 5:00 AM.; signing inventory; sign repair, replace; fix mailboxes in various locations; rock resurfacing, contract rock maps; 1-24-16 one ways out at 5:30-8:30 AM; Boyd bridge plans; B22 box culvert letting, K Construction; construction program, five year plan; INRCOG, Waterloo on Thursday; budget review; etc.

 

Motion by Holthaus, Seconded by Geerts to open the public hearing at 11:00AM for abandonment and to accept the offer to buy a parcel of real estate in the NW Ό NW Ό of Section 28-T97N-R12 property to Clair and Dorothy Huber.  Roll Call:  All Ayes. Motion Carried.  Also present from the public were Assistant County Attorney Mark Huegel and Conservation Director Brian Moore.

 

No written or oral comments from the public. 

 

Motion by Holthaus, Seconded by Geerts to close the public hearing at 11:04 AM.              

Roll Call:  All Ayes. Motion Carried.

 

Motion by Holthaus, Seconded by Geerts to approve Resolution 01-25-16-06 abandonment and to accept the offer to buy a parcel of real estate in the NW Ό NW Ό of Section 28-T97N-R12 property to Clair and Dorothy Huber.  Roll Call:  All Ayes.  Motion Carried. RESOLUTION NO. 01-25-16-06 A RESOLUTION ABANDONING AND ACCEPTING THE OFFER TO BUY REAL ESTATE AND ACCEPTANCE AND SELLING A PARCEL OF REAL ESTATE CONTAINING 966 SQUARE FEET, LEGALLY DESCRIBED AS: COMMENCING AT THE NORTHEAST CORNER OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 28, TOWNSHIP 97 NORTH, RANGE 12 WEST OF THE 5TH P.M. IN CHICKASAW COUNTY, IOWA; thence south 03°00’10” EAST, 1089.65 feet along the east line of said quarter-quarter section to the point of beginning; thence continuing south 03°00’10” east, 70.00 feet along said east line to the east right-of-way line of nolan avenue; thence north 26°14’02” west, 70.00 feet along said east right-of-way line; thence north 75°22’54” east, 28.19 feet to the point of beginning. WHEREAS, Chickasaw County owns a parcel of real estate described herein above which they have granted an Ingress and Egress Easement to Clair Huber and Dorothy Huber, and WHEREAS, it is in the best interest of Chickasaw County, Iowa to abandon the above described real estate, and WHEREAS, it is in the best interests of Chickasaw County, Iowa, to sell the real estate described as follows:  COMMENCING AT THE NORTHEAST CORNER OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 28, TOWNSHIP 97 NORTH, RANGE 12 WEST OF THE 5TH P.M. IN CHICKASAW COUNTY, IOWA; THENCE SOUTH 03°00’10” EAST, 1089.65 FEET ALONG THE EAST LINE OF SAID QUARTER-QUARTER SECTION TO THE POINT OF BEGINNING; THENCE CONTINUING SOUTH 03°00’10” EAST, 70.00 FEET ALONG SAID EAST LINE TO THE EAST RIGHT-OF-WAY LINE OF NOLAN AVENUE; THENCE NORTH 26°14’02” WEST, 70.00 FEET ALONG SAID EAST RIGHT-OF-WAY LINE; THENCE NORTH 75°22’54” EAST, 28.19 FEET TO THE POINT OF BEGINNING to the adjacent land owners, Clair Huber and Dorothy Huber, for the sum of $1.00 as set forth on the written offer to buy said property by Clair Huber and Dorothy Huber and that said property be abandoned by Chickasaw County, for the purpose of said sale. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Chickasaw County Board of Supervisors of Chickasaw County, Iowa: 1.  The best interests of Chickasaw County, Iowa, and the citizens thereof require that formal action be taken for the abandonment and sale of a parcel of real estate containing 966 square feet, legally described as:  COMMENCING AT THE NORTHEAST CORNER OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 28, TOWNSHIP 97 NORTH, RANGE 12 WEST OF THE 5TH P.M. IN CHICKASAW COUNTY, IOWA; THENCE SOUTH 03°00’10” EAST, 1089.65 FEET ALONG THE EAST LINE OF SAID QUARTER-QUARTER SECTION TO THE POINT OF BEGINNING; THENCE CONTINUING SOUTH 03°00’10” EAST, 70.00 FEET ALONG SAID EAST LINE TO THE EAST RIGHT-OF-WAY LINE OF NOLAN AVENUE; THENCE NORTH 26°14’02” WEST, 70.00 FEET ALONG SAID EAST RIGHT-OF-WAY LINE; THENCE NORTH 75°22’54” EAST, 28.19 FEET TO THE POINT OF BEGINNING 2.  That the sale of said property described in paragraph 1 above, be to Clair Huber and Dorothy Huber for the sale price of $1.00 and other valuable consideration. 3.  That at a public hearing held on the 25th day of January, 2016, there were no written objections filed or objections filed or registered with the Chickasaw County Board of Supervisors for the sale and abandonment of said property.  4. That at a meeting before the Board of Supervisors of Chickasaw County, Iowa on the 25th day of January, 2016, the Chickasaw County Board of Supervisors does hereby accept the Offer to Buy Real Estate and Acceptance as prepared for the property described herein above and below and does hereby accept the sale price of One Dollar ($1.00) and other valuable consideration for a strip of real estate containing 966 square feet, legally described as:  COMMENCING AT THE NORTHEAST CORNER OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 28, TOWNSHIP 97 NORTH, RANGE 12 WEST OF THE 5TH P.M. IN CHICKASAW COUNTY, IOWA; THENCE SOUTH 03°00’10” EAST, 1089.65 FEET ALONG THE EAST LINE OF SAID QUARTER-QUARTER SECTION TO THE POINT OF BEGINNING; THENCE CONTINUING SOUTH 03°00’10” EAST, 70.00 FEET ALONG SAID EAST LINE TO THE EAST RIGHT-OF-WAY LINE OF NOLAN AVENUE; THENCE NORTH 26°14’02” WEST, 70.00 FEET ALONG SAID EAST RIGHT-OF-WAY LINE; THENCE NORTH 75°22’54” EAST, 28.19 FEET TO THE POINT OF BEGINNING. 5.  That the Chickasaw County Chairman of the Board of Supervisors and the Chickasaw County Auditor are hereby directed to sign all of the appropriate documents to transfer said real estate pursuant to the terms and conditions set forth hereinabove. DONE THIS 25TH DAY OF JANUARY, 2016, BY THE CHICKASAW COUNTY BOARD OF SUPERVISORS, NEW HAMPTON, CHICKASAW COUNTY, IOWA, AT A MEETING HELD AT 11:00 O’CLOCK A.M. The Board discussed the December 30, 2015 Board Minutes.  Also present was Assistant County Attorney Mark Huegel.

 

Motion by Geerts, Seconded by Holthaus to reconsider the December 30, 2015 Motion by Geerts, Seconded by Andersen to reduce the Compensation Board recommendations for the Sheriff, Auditor, Treasurer and Recorder from 3.50 percent to 3.00 percent and Attorney from 3.00 percent to 2.5 percent to be in compliance with Iowa Code Section 331.907 (2) by adjusting the percentages to be equal across the Board.  Roll Call:  Ayes: Geerts, Holthaus, Carolan and Andersen.  Nays: Zoll.  Motion Carried.

 

Motion by Geerts, Seconded by Holthaus to reduce the Compensation Board recommendation by 14.30 percent for the offices of Sheriff, Auditor, Treasurer, Recorder and Attorney.  Roll Call: Ayes:  Geerts, Holthaus and Andersen.  Nays: Zoll and Carolan.  Motion Carried.

 

Motion by Holthaus, Seconded by Geerts to adopt Resolution 01-25-16-07 to set the compensation for elected officials for FY 2016-17.  Roll Call: Ayes: Holthaus, Geerts and Andersen. Nays: Carolan and Zoll.  Motion Carried. RESOLUTION NO. 01-25-16-07   WHEREAS, the Chickasaw County Board of Supervisors has received the recommendations of the Chickasaw County Compensation Board which met on Wednesday, December 16, 2015; and   WHEREAS, the Chickasaw County Board of Supervisors hereby reduces the recommended proposed increases by the Chickasaw County Compensation Board by 14.3 percent, and    WHEREAS,  the Chickasaw County Compensation Board recommended a proposed increase of five (5) percent for the Board of Supervisors-$1,327.00; a proposed increase of three and one half (3.50) percent for the Sheriff-$2.426.00, Auditor-$1,831.00, Treasurer-$1,831.00 and Recorder-$1,831.00; a proposed increase of three (3) percent for Attorney-$2,808.00; and NOW, THEREFORE BE IT RESOLVED the Board of Supervisors of Chickasaw County, Iowa hereby set the compensation increase of the Chickasaw County elected officials to be as follows:  Three and one half (3.50) percent Board of Supervisors-$929.00; three (3) percent for Sheriff-$2,079.00; Auditor-$1,569.00; Treasurer-$1,569.00; and Recorder-$1,569.00; Two and fifty-seven one hundredth (2.57) percent Attorney-$2,406.00 for the fiscal year 2016-2017. Passed and approved this 19th day of January, 2016. Ayes: /ss/ John Andersen, Chairman, Board of Supervisor, Steve Geerts, Rick Holthaus. Nays: Tim Zoll and Dan Carolan.  ATTEST: /ss/ Joan E. Knoll, County Auditor.

 

The Board recessed at 11:40 AM and reconvened at 1:00 PM.

 

Chief Deputy Marty Hemann, County Attorney Pat Wegman, Mayor Shain Kroenecke and Administrator Cindy Lantow met with the Board to discuss the FY 2016-17 Law Enforcement Contract with the City of Fredericksburg.  Also present were Assistant County Attorney Mark Huegel, Sheriff Todd Miller and a member from the media.

 

Motion by Carolan, Seconded by Geerts to adjourn the meeting at 1:55 PM.  Roll Call: All Ayes. Motion Carried.

Conservation Director Brian Moore met with the Board to review FY 2016-17 budget.

 

Ken Rasing met with the Board to review FY 2016-17 budget.  Also present was Staci Schutte and Ginger Rasmussen.

 

The Board recessed at 11:42 AM and reconvened at 1:00 PM.

 

Chief Deputy Marty Hemann met with the Board to review FY 2016-17 budget.

Received and filed in the Auditor’s Office MMP Short Form for Annual Updates for Linden Creek LLC-Koudelka Site in Section 26 of Jacksonville Township located at 2624 110th Street, Lawler, IA 52154.
