COUNTY BOARD MINUTES DECEMBER 5 & 6, 2016 The Board convened on Monday, December 5, 2016 at 9:30 AM with the following members present: Carolan, Andersen, and Zoll. Absent: Geerts and Holthaus. Supervisor Holthaus is attending a meeting in Des Moines. The meeting was called to order by Chairman Andersen. Mail was opened and distributed. Also present was Supervisor- Elect Hackman at 9:45 A.M. Motion by Carolan, Seconded by Zoll to approve agenda for December 5, & 6, 2016. Roll Call: Ayes: Carolan, Zoll and Andersen. Absent: Geerts and Holthaus. Motion Carried. Motion by Carolan, Seconded by Zoll to approve board minutes of November 21, 2016. Roll Call: Ayes: Carolan, Zoll and Andersen. Absent: Geerts and Holthaus. Motion Carried. Custodian Dave Gorman met with the Board to discuss the installation of the fan at the Jail Facility in the booking room. Dave Gorman will contact the vendors and update the Board of the progress at a later date. The County Engineer Dusten Rolando met with the Board to discuss road departmental activities. Topics included: maintenance and service of vehicles; maintenance of gravel roads; FEMA paperwork continues; entrance permits in various areas; 6-one ways on Sunday, 12-4-16 at 5:30 A.M.; deliver sand tomorrow; boom mower, out, cutting back; motorgraders out, spot blading, potholes; some spot rocking in various areas; put snow equipment on; sander out on Friday, Northeast, bridges, on 12-2-2016; sign repair in various areas; opened up on Beaumont, box culvert; flowable mortar, grout, Kouts box culvert; patch bridge, Waucoma bridge; fixed expansion joint, Waucoma bridge; Boice quarry, crushing road rock, Plate quarry; etc updating bridge info, SIIMS; survey work, day labor projects, next year; pavement marking plans, submittals; ISAC-Des Moines, Wednesday, and Thursday; Engineers conference-Ames this week; begin FY 18 budget; etc. Motion by Carolan, Seconded by Zoll to renew the Adopt a Highway permit for the North Washington Volunteer Fire Department to remove litter along V18 from 155th Street south to 180th Street as per the recommendation of the County Engineer. Roll Call: Ayes: Carolan, Zoll and Andersen. Absent: Geerts and Holthaus. Motion Carried. Motion by Zoll, Seconded by Carolan to approve the permit for Butler County REC to place underground and overhead construction in the county right of way along South Linn Avenue to serve a new 911 tower located at 2323 S. Linn Avenue, New Hampton, Iowa as per the recommendation of the County Engineer. Roll Call: Ayes: Carolan, Zoll and Andersen. Absent: Geerts and Holthaus. Motion Carried. The Board reviewed the secretarial agreement with Howard County for the County Attorney’s Office. Present was Assistant County Attorney Mark Huegel. Motion by Zoll, Seconded by Carolan to enter the secretarial agreement with Howard County. Roll Call: Ayes: Carolan, Zoll and Andersen. Absent: Geerts and Holthaus. Motion Carried. Teamsters Union Representative Dave Miller met with the Board to present the union proposals. Deputy Reed Palo met with the Board to discuss mental health transportation. Also present were County Attorney Pat Wegman, Assistant County Attorney Mark Huegel, Bobbi Jo O’Donnell, Jeremy McGrath, Ken Rasing, and a member from the media. Discussion followed and more discussion to follow at a later date. Assistant County Attorney Mark Huegel met with the Board to discuss county rental property payments from the Flick 2017-2022. Motion by Carolan, Seconded by Zoll to approve Resolution 12-05-16-42 to set aside the rental payments from the Flick 2017-2022 rental ground in the Capital Projects fund. Roll Call: Ayes: Carolan, Holthaus, Zoll and Andersen. Absent: Geerts. Motion Carried. RESOLUTION NO. 12-05-16-42 A RESOLUTION SETTING ASIDE FUNDS FOR CAPITAL IMPROVEMENTS. WHEREAS, the Chickasaw County Board of Supervisors have determined that it is necessary to set aside funds for capital improvements, and WHEREAS, the Chickasaw County Board of Supervisors desire to continue to set aside funds for capital improvements, and WHEREAS, Chickasaw County receives payments for rental grounds described as follows: 65.7 acres more or less located in the Northeast Quarter (N¼) of Section 28, Township 95 North, Range 13 West of the 5th P.M. in Chickasaw County, Iowa. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Chickasaw County, Iowa, as follows: 1. That the rental payments for the above described property shall be set and directed to the capital project fund. 2. The Chickasaw County Auditor is directed to place said payments, when received by the tenant, in the capital project fund. PASSED, APPROVED, and adopted this 5th day of December, 2016, the vote thereon being as follows: AYES: /ss/John Andersen, Chairman, Board of Supervisors, Dan Carolan, Tim Zoll. Nays: None. Absent: Steve Geerts and Rick Holthaus. ATTEST: Joan E. Knoll, Auditor. Ken Rasing met with the Board to discuss the radio tower project. Also present was Terry Harris with RC Systems Radio Communications. Motion by Carolan, Seconded by Zoll to accept the bid from RC Systems Radio Communication for a 12 foot x 14 foot. Thermobond communications shelter in the amount of $44,983.00. Roll Call: Ayes: Carolan, Zoll and Andersen. Absent: Geerts and Holthaus. Motion Carried. Member from the media left at 12:16 P.M. The meeting was called to order by Chairman Andersen. Mail was opened and distributed. Land Use Administrator Staci Schutte met with the Board for the approval of a minor subdivision. Motion by Carolan, Seconded by Holthaus to approve Resolution 12-06-16-43 and authorize Chairman Signature for the minor subdivision for Treloar Sisters Family Farm, LLC as per the recommendation of the Land Use Administrator. Roll Call: Ayes: Carolan, Holthaus, l and Andersen. Absent: Geerts and Zoll. Motion Carried. RESOLUTION 12-06-16-43 A RESOLUTION APPROVING THE MINOR SUBDIVISION PLAT OF PARCELS D AND E IN THE SOUTHWEST QUARTER OF SECTION 36, TOWNSHIP 94 NORTH, RANGE 11 WEST OF THE 5TH P.M., CHICKASAW COUNTY, IOWA. WHEREAS, ON THE 6th DAY of December at a regular meeting by the Board of Supervisors, Chickasaw County, Iowa a minor subdivision plat of Parcels D and E in the Southwest Quarter of Section 36, Township 94 North, Range 11 West of the 5th P.M., Chickasaw County, Iowa was presented. WHEREAS, the minor subdivision plat of Parcels D and E in the Southwest Quarter of Section 36, Township 94 North, Range 11 West of the 5th P.M., Chickasaw County, Iowa has been considered and should be approved. NOW, THEREFORE, it is hereby resolved by the Board of Supervisors, Chickasaw County, Iowa that said Minor Subdivision Plat be approved, accepted and the Chairman is hereby directed to certify this Resolution of Approval. Supervisor Holthaus gave an update on the County Social Services meeting held on November 23, 2016 and IGHCP meetings in Des Moines on November 30, 2016 and December 5, 2016. Supervisor Zoll present at 10:00 AM. Treasurer Sue Breitbach met with Board to discuss a property in Nashua. Sue Breitbach reviewed the tax charge informational sheets for Parcels 191318476095 and 191318476096. Discussion followed. Sue Breitbach will contact Scott Hotlovy and will meet with the Board at a later date. Conservation Director Brian Moore met with the Board for a departmental update. Also present was a member at the media and Assistant County Attorney Mark Huegel was present at 10:40 AM. Assistant County Attorney Mark Huegel met with the Board to discuss the resolution setting forth the intent of the Chickasaw County to vacate and abandon all streets, roads and alleys of John Casey Addition to Lawler, Chickasaw County, Iowa. Also present was Assessor Doug Welton. RESOLUTION NO. 12-6-16-44 A RESOLUTION SETTING FORTH THE INTENT OF CHICKASAW COUNTY TO VACATE AND ABANDON ALL STREETS, ROADS AND ALLEYS OF JOHN CASEY ADDITION TO LAWLER, CHICKASAW COUNTY, IOWA WHEREAS, there are streets, roads and alleys in the John Casey Addition to Lawler that are no longer utilized or maintained, and WHEREAS, the Board of Supervisors of Chickasaw County, Iowa has determined that the continued ownership of said roads, streets and alleys is a detriment to the citizens of Chickasaw County, Iowa, and WHEREAS, the Board of Supervisors of Chickasaw County, Iowa has determined that it is in the best interest of the citizens of Chickasaw County, Iowa to vacate and abandon said road, streets and alleys, and WHEREAS, a public hearing shall be set at which time and place the said Chickasaw County, Iowa, Board of Supervisors will consider arguments for or against the vacating and abandonment of said streets, roads and alleys. NOW THEREFORE, BE IT HEREBY RESOLVED that a public hearing thereon will be held in the Chickasaw County Board of Supervisors meeting room at the Courthouse in New Hampton, Chickasaw County, Iowa on the 3rd day of January, 2017 at 11:30 a.m. at which time and place the Chickasaw County Board of Supervisors will consider arguments for or against the vacating and abandonment of the streets, alleys and roads in the John Casey Addition to Lawler, Chickasaw County, Iowa. BE IT FURTHER RESOLVED, the Chickasaw County Auditor is hereby authorized and directed to cause to be published notice of such hearing on the time not less than four (4) days or more than twenty (20) days prior to the date herein established for hearing as provided by law. A copy of said Notice of Public Hearing is attached hereto marked Exhibit “A”, and is incorporated herein as though set forth verbatim. A public hearing on the vacating and abandonment of said streets, alleys and roads will be held at 11:30 o’clock a.m. on January 3, 2017 at the Chickasaw County Board of Supervisors Meeting Room at the Courthouse at 8 East Prospect, New Hampton, Chickasaw County, Iowa. At this hearing any interested person may appear and voice or file written objections to the proposed vacating and abandonment of said streets, roads and alleys.
