COUNTY BOARD MINUTES APRIL 3, 2017 The Board convened on Monday, April 3, 2017 at 9:00 A.M. with all the members present: Zoll, Geerts, Tilkes, Carolan, and Hackman. The meeting was called to order by Chairman Zoll. Mail was opened and distributed. Motion by Geerts, Seconded by Hackman to approve agenda for April 3, 2017. Roll Call: All Ayes. Motion Carried. Motion by Hackman, Seconded by Carolan to approve Board Minutes for March 27, 2017. Roll Call: All Ayes. Motion Carried. Terry Johnson present at 9:10 AM. Motion by Hackman, Seconded by Geerts to appoint Sheila Kobliska as interim General Assistance Director. Roll Call: All Ayes. Motion Carried. The Board reviewed the lowering requested tax dollars for County MH-DD fund from $411,103.00 to $401,375.00 for FY 2018 budget. Motion by Hackman, Seconded by Geerts to approve Resolution No. 04-03-17-18 approving a reduction in the levy amount for Mental Health and Disabilities Services Fund. Roll Call: All Ayes. Motion Carried. RESOLUTION NO. 04-03-17-18 A RESOLUTION APPROVING A REDUCTION IN THE LEVY AMOUNT FOR MENTAL HEALTH AND DISABILITIES SERVICE FUND. WHEREAS, County Social Services Board on November 23, 2016 met and set the levy for Mental Health and Disabilities Service Fund at $35.18 per capita, totaling $411,103.00 property taxes levied for fiscal year 2017-2018, and WHEREAS, the Chickasaw County Board of Supervisors approved and adopted the county budget for fiscal year 2017-2018 on March 6, 2017 certifying $411,103.00 property taxes levied for Mental Health and Disabilities Service Fund. WHEREAS, County Social Services Board met on March 22, 2017 and reduced the per capita levy for Mental Health and Disabilities Service Fund from $35.18 per capital to $33.18 per capital totaling $401,375.00 property taxes levied. BE IT HEREBY RESOLVED that the Chickasaw County Board of Supervisors reduces the levy amount for the Mental Health and Disabilities Services Fund from $35.18 per capita to $33.18 per capita for fiscal year 2017-2018, adjusting the total property taxes levied to $401,375.00. DONE THIS 3RD DAY OF APRIL, 2017. AYES: /ss/ Tim Zoll, Chairman Board of Supervisors, Jacob Hackman, Dan Carolan, David Tilkes, Steve Geerts. NAYS: None. ATTEST: /ss/ Joan E. Knoll Chickasaw County Auditor The Board discussed the Cost Advisory Services, Inc. contract. Cost Advisory Services, Inc. provides cost allocation to Chickasaw County to ensure that the indirect cost recovery program is maximized for all Iowa counties. They provide these services for 93 Iowa Counties. Motion by Carolan, Seconded by Hackman to sign contract with Cost Advisory Services, Inc (CAS) to provide professional consulting services to Chickasaw County for a three (3) years for FY 2017 through 2019 at the annual fee of $4,125.00 and authorize Chairman Signature. Roll Call: All Ayes. Motion Carried. The Board reviewed the letter from Cedar Valley RC & D. Currently Cedar Valley RC & D have a little over $42,000.00 in our account that was raised through our water quality, energy and new business assistance project assistance. Cedar Valley RC & D are recommending that a request for proposal (RFP) be sent to the seven sponsoring Soil and Water Conservation Districts (SWCD) and County Supervisors for them to respond with how they would use their share of the funds. Some examples of what the funds could be used for are: water quality and soil health programming, scholarships, water testing for projects, or matching funds for a project. They would like the Board’s decision by April 30th. Supervisors Zoll will contact Cedar Valley RC & D for further information and update the Board at the next Board meeting. Supervisors Zoll and Hackman reviewed with the Board the Access/Policy & Procedures for the Community Services Building (CSB). Discussion followed. Supervisor Hackman will make the two changes for the Board to review. Motion by Hackman, Seconded by Carolan to approve the Access/Policy & Procedures for the Community Services Building (CSB) effective April 3, 2017 and a map of the facility with the corresponding letters is also included. Roll Call: All Ayes. Motion Carried. The Board will discuss the number of keys to be issued at next week’s meeting. Motion by Hackman, Seconded by Carolan to open the public hearing to vacate and abandon 1st Street South of Mill Street A/K/A 220th Street in the Village of Chickasaw, Chickasaw County, Iowa at 9:30 AM. Roll Call: All Ayes. Motion Carried. Also present were Deputy Assessor Ray Armel, Assistant County Attorney Mark Huegel, and County Engineer Dusten Rolando. No written or verbal comments from the public. Motion by Hackman, Seconded by Geerts to close the public hearing at 9:35 AM. Roll Call: All Ayes. Motion Carried. Motion by Geerts, Seconded by Carolan to approve Resolution 04-03-17-12. Roll Call: All Ayes. Motion Carried. RESOLUTION NO. 04-03-17-12 A RESOLUTION SETTING FORTH THE INTENT OF CHICKASAW COUNTY TO VACATE AND ABANDON 1ST STREET SOUTH OF MILL STREET A/K/A 220TH STREET IN THE VILLAGE OF CHICKASAW, CHICKASAW COUNTY, IOWA WHEREAS, 1st Street South of Mill Street, a/k/a 220th Street in the Village of Chickasaw is no longer utilized or maintained, and WHEREAS, the Board of Supervisors of Chickasaw County, Iowa has determined that continued ownership of said street is a detriment to the citizens of Chickasaw County, Iowa, and WHEREAS, the Board of Supervisors of Chickasaw County, Iowa has determined that it is in the best interest of the citizens of Chickasaw County, Iowa to vacate and abandon said street, and WHEREAS, Sylvia Jean Welter, the adjacent land owner, has the only ingress and egress across to the above described property, and WHEREAS, Sylvia Jean Welter has and is utilizing said property at the current time, and WHEREAS, a public hearing shall be set at which time and place the said Chickasaw County, Iowa, Board of Supervisors will consider arguments for or against the vacating and abandonment of said street and the transfer of said street to Sylvia Jean Welter. NOW THEREFORE, BE IT HEREBY RESOLVED that a public hearing thereon will be held in the Chickasaw County Board of Supervisors meeting room at the Courthouse in New Hampton, Chickasaw County, Iowa on the 3rd day of April, 2017 at 9:30 a.m. at which time and place the Chickasaw County Board of Supervisors will consider arguments for or against the vacating and abandonment of said street and the transfer of 1st Street South of Mill Street, a/k/a 220th Street, in the Village of Chickasaw, Chickasaw County, Iowa to Sylvia Jean Welter. RESOLUTION NO. 04-03-17-15 RESOLUTION VACATING AND ABANDONING 1ST STREET SOUTH OF MILL STREET, A/K/A 220TH STREET IN THE VILLAGE OF CHICKASAW, CHICKASAW COUNTY, IOWA AND AUTHORIZING THE CONVEYANCE OF SAID PROPERTY TO SYLVIA JEAN WELTER. WHEREAS, 1st Street South of Mill Street, a/k/a 220th Street, in the Village of Chickasaw, Chickasaw County, Iowa is no longer utilized or maintained, and WHEREAS, the Board of Supervisors of Chickasaw County, Iowa held a public hearing on April 3, 2017 at 9:30 a.m. and received no written or verbal complaints or objections from the public with regard to the proposed abandonment and vacation of said street, and WHEREAS, the Board of Supervisors of Chickasaw County, Iowa had determined that it is in the best interests of the citizens of Chickasaw County, Iowa to vacate and abandon said 1st Street South of Mill Street, a/k/a 220th Street, in the Village of Chickasaw, Chickasaw County, Iowa, and WHEREAS, 1st Street South of Mill Street, a/k/a 220th Street, in the Village of Chickasaw, Chickasaw County, Iowa was never developed nor utilized by the public, and WHEREAS, Sylvia Jean Welter is the only adjacent land owner to said 1st Street South of Mill Street, a/k/a 220th Street, in the Village of Chickasaw, Chickasaw County, Iowa. RESOLUTION NO. 04-03-17-16 A RESOLUTION SETTING FORTH THE INTENT OF CHICKASAW COUNTY TO VACATE AND ABANDON PARCEL E, PARCEL F AND PARCEL G ALL IN THE SE¼ NE¼ OF SECTION 21, TOWNSHIP 95 NORTH, RANGE 14 WEST OF THE 5TH P.M., CHICKASAW COUNTY, IOWA WHEREAS, Parcels E, F and G all in the SE¼ NE¼ of Section 21, Township 95 North, Range 14 West 14 West of the 5th P.M., Chickasaw County, Iowa, are no longer used as part of the right-of-way for 220th Street, and WHEREAS, the Board of Supervisors of Chickasaw County, Iowa has determined that continued ownership of said Parcels E, F and G is detrimental to the citizens of Chickasaw County, Iowa, and WHEREAS, the Board of Supervisors of Chickasaw County, Iowa has determined that it is in the best interest of the citizens of Chickasaw County, Iowa to vacate and abandon said Parcels E, F and G, and WHEREAS, Parcels E, F and G all in the SE¼ NE¼ of Section 21, Township 95 North, Range 14 West of the 5th P.M., Chickasaw County, Iowa are insufficient in size to function as a standalone site for possible development, and WHEREAS, Gary Taylor and Barbara Richter are the adjacent landowners and have been utilizing said property at the current time. RESOLUTION NO. 04-03-17-17 A RESOLUTION SETTING FORTH THE CHICKASAW COUNTY BOARD OF SUPERVISORS INTENT TO SELL AND ABANDON LOT 1 NW¼ SECTION 34, TOWNSHIP 97 NORTH, RANGE 12 WEST OF THE 5TH P.M., CHICKASAW COUNTY, STATE OF IOWA. WHEREAS, Chickasaw County owns Lot 1 NW¼, Section 34, Township 97 North, Range 12 West of the 5th P.M., and WHEREAS, the said property described herein above is of no value and use to Chickasaw County, and WHEREAS, the Board of Supervisors of Chickasaw County, Iowa, has determined that the continued ownership of the above described real estate is a detriment to the citizens of Chickasaw County, Iowa, and WHEREAS, the Board of Supervisors of Chickasaw County, Iowa, has determined that it is in the best interests of the citizens of Chickasaw County, Iowa, that the real estate described herein above be abandoned by Chickasaw County for the purpose of sale, and WHEREAS, the adjacent land owners, Dennis F. Knutson and JoAnne Knutson, are the adjacent land owners to said property and have expressed an interest in acquiring said property, and WHEREAS, it is in the best interest of Chickasaw County, Iowa, to sell the real estate described as follows: Lot 1 NW¼, Section 34, Township 97 North, Range 12 West of the 5th P.M., Chickasaw County, Iowa. That the best interests of Chickasaw County, Iowa, and the citizens thereof require that formal action be taken for the abandonment and sale of Lot 1 NW¼, Section 34, Township 97 North, Range 12 West of the 5th P.M., Chickasaw County, Iowa. 2. That the sale of said property described in paragraph 1 above, be completed with the sale of said property immediately after a public hearing by auction to those people that have expressed a written interest in purchasing the same property. 3. That the property subject to this sale be sold pursuant to the legal description provided for herein. That the buyer of said property shall be responsible for any survey at buyer’s expense if any discrepancy, dispute or concern of any nature regarding the property being subject to this sale at the present time or any future time exists. Additionally, the costs of obtaining or continuing an abstract of title to said property, as well as closing costs including but not limited to, attorney’s fees, recording fees and abstracting fees, will be at the expense of the buyer. 4. THAT THE BUYER IS PURCHASING SAID PROPERTY “AS IS”. 5. A public hearing on the acceptance of said sale will be held at 9:45 a.m. on April 24, 2017 in the Board of Supervisors Room at the Chickasaw County Courthouse, New Hampton, Iowa. Topics included: maintenance and service of vehicles; maintenance of gravel roads; work orders, shoulder repair, several locations; maintenance supervisors, foreman meeting, Charles City, District 2; CMP delivered to yard; removing snow equipment; signing repairs; setting up detour signs, bridge project, Boyd Road; fixed mailbox, 160th Street; motorgraders out, spot blading; still wet; hauled spot rock, several locations; bridge repair, rail, BR#2400; cut brush, various spots; day labor project, survey, box culverts; reviewed Gilmore Avenue, remove & Pave; Boyd Road bridge starts today; rock resurfacing letting today; review proposal vortex durapatcher; FEMA Flood 1 complete, close on Flood 2; 5 yr construction program; budget FY 18 IDOT; FY 17 budget amendment end of April; MSHA training Thursday; etc Chairman Zoll received and opened bids for limestone surfacing contracts for Divisions I, II, III, and IV at 10:00 AM. Vendors present included Lee Pries, representing Paul Niemann Construction; Chad Wiltgen, representing Wiltgen Construction, Inc.; Keith B. Bruening, representing Bruening Rock Products, and Barry Klingman, County Road Foreman. Discussion followed. Motion by Geerts, Seconded by Hackman to approve the recommendation of the County Engineer and authorize Chairman Signature on vendor limestone surfacing contracts with Paul Niemann Const. Co. for $308,479.34 for Division 1; Wiltgen Const. for $284,909.46 for Division II; Bruening Rock Products for $332,709.83 for Division III; and Bruening Rock Products for $272,846.53 for Division IV. Roll Call: Ayes: Geerts, Hackman, Tilkes and Zoll. Abstain: Carolan. Motion Carried. County Engineer discussed with the Board the purchase of a durapatcher and a nurse tank. Discussion followed. Motion by Carolan, Seconded by Hackman to accept the quote from Vortex in the total amount of $92,500.00 ($63,000.00 Durapatcher and $29,500.00 nurse tank) as per the recommendation of the County Engineer. Roll Call: All Ayes. Motion Carried. Sheriff Marty Hemann met with the Board for a departmental update. Also present was Prescott Egemo. Motion by Hackman, Seconded by Carolan to acknowledge the hiring of Prescott Egemo as Deputy Sheriff as per union contract effective April 3, 2017. Roll Call: All Ayes. Motion Carried. Motion by Tilkes, Seconded by Geerts to appoint Kristine Markham to the Civil Service Commission for a six year term which would expire on January 1, 2023 as per the recommendation of the County Sheriff. Roll Call: All Ayes. Motion Carried The Board discussed the Veteran’s Affairs Commission. Also present were County Attorney Pat Wegman and Assistant County Attorney Mark Huegel. Discussion followed. Supervisors Geerts and Tilkes will contact the Veterans Affairs Commission and update the Board of their findings. The Board discussed the Veteran’s Affairs Commission Board member opening which expires June 30, 2017. The Board took no action at this time. The Board discussed the Law and Emergency Management Center building lease agreement. The County Attorney will contact the landlord and update the Board at a later date. The Board recessed at 11:38 AM and reconvened at 1:00 PM. At 1:00 PM the Board discussed the Medical Examiner Investigator position. Present were Jeremy McGrath, Jim Cook, County Attorney Pat Wegman and a member from the media. The concerns were addressed and would be readdressed at the 5:30 PM. meeting. City of Nashua Police Chief Paul Becthold and Nashua Police Officer Sergeant Travis Marvin met with the Board to discuss communications concerns. Also present were Jeremy McGrath, Sheriff Marty Hemann, Chief Deputy Reed Palo, and Assistant County Attorney Mark Huegel. The Nashua Police Department addressed their concerns regarding communications to the Board. The Board recessed at 2:50 PM and reconvened at 5:30 PM.
