COUNTY BOARD MINUTES APRIL 24, 2017 The Board convened on Monday, April 24, 2017 at 9:01 A.M. with all the members present: Zoll, Geerts, Tilkes, Carolan, and Hackman. The meeting was called to order by Chairman Zoll. Mail was opened and distributed. Also present was a member from the media. Motion by Geerts, Seconded by Hackman to approve agenda for April 24, 2017. Roll Call: All Ayes. Motion Carried. Motion by Carolan, Seconded by Tilkes to approve Board Minutes for April 17, 2017. Roll Call: All Ayes. Motion Carried. The Pioneer Cemetery Commission met with the Board to proclaim that May is Cemetery month President Wally Boehmer of the Pioneer Cemetery Commission met with the Board to sign a Proclamation for the month of May as Cemetery Appreciation month in Iowa. Also present were Vice Chairman Dale Liddle, Secretary Judy Liddle, Volunteers Philomena Boehmer, Fred Reisner, Priscilla Reisner, Adis Lee, and Bonnie Keller. Motion by Hackman, Seconded by Geerts to authorize Chairman Signature on the Proclamation for the month of May 2017 as Cemetery Appreciation Month in Iowa. Roll Call: All Ayes. Motion Carried. Member from the media left at 9:10AM. Motion by Tilkes, Seconded by Carolan to approve Outdoor Service Privilege for one day for Jerico Jo’s. Roll Call: All Ayes. Motion Carried. Motion by Geerts, Seconded by Hackman to approve and authorize Chairman Signature on the Employee Benefit Systems (EBS) (Third Party Administration) Partial Self-Funded Plan Renewal for Chickasaw County for FY 2017-2018. Roll Call: All Ayes. Motion Carried. Motion by Hackman, Seconded by Carolan to open the public hearing to vacate and abandon Parcel E, Parcel F, and Parcel G all in the SE ¼ NE ¼ of Section 21, Township 95 North, Range 14 West of the 5th P.M. Chickasaw County, Iowa at 9:30 AM. Roll Call: All Ayes. Motion Carried. Also present were Deputy Assessor Ray Armel and Assistant County Attorney Mark Huegel, County Engineer Dusten Rolando, and Barb Richter. No written or verbal comments from the public. Barb Richter informed the Board that the property has been surveyed. Motion by Hackman, Seconded by Geerts to close the public hearing at 9:32 AM. Roll Call: All Ayes. Motion Carried. Motion by Carolan, Seconded by Hackman to approve Resolution 04-24-17-19. Roll Call: All Ayes. Motion Carried. RESOLUTION NO. 04-24-17-19 RESOLUTION VACATING AND ABANDONING PARCEL E, PARCEL F AND PARCEL G, ALL IN THE SE¼ NE¼ OF SECTION 21, TOWNSHIP 95 NORTH, RANGE 14 WEST OF THE 5TH P.M., CHICKASAW COUNTY, IOWA AND AUTHORIZING THE CONVEYANCE OF SAID PROPERTY TO GARY TAYLOR AND BARBARA RICHTER. WHEREAS, Parcel E, Parcel F and Parcel G all in the SE¼ NE¼ of Section 21, Township 95 North, Range 14 West 14 West of the 5th P.M., Chickasaw County, Iowa is no longer utilized as part of the right-of-way for 220th Street, and WHEREAS, the Board of Supervisors of Chickasaw County, Iowa held a public hearing on April 24, 2017 at 9:30 a.m. and received no written or verbal complaints or objections from the public with regard to the proposed abandonment and vacation of said Parcel E, Parcel F and Parcel G all in the SE¼ NE¼ of Section 21, Township 95 North, Range 14 West 14 West of the 5th P.M., Chickasaw County, Iowa, and WHEREAS, the Board of Supervisors of Chickasaw County, Iowa had determined that it is in the best interests of the citizens of Chickasaw County, Iowa to vacate and abandon said Parcel E, Parcel F and Parcel G all in the SE¼ NE¼ of Section 21, Township 95 North, Range 14 West 14 West of the 5th P.M., Chickasaw County, Iowa, and WHEREAS, Parcel E, Parcel F and Parcel G all in the SE¼ NE¼ of Section 21, Township 95 North, Range 14 West 14 West of the 5th P.M., Chickasaw County, Iowa is no longer used as part of the right-of-way for 220th Street, and WHEREAS, Gary Taylor and Barbara Righter are the only adjacent land owners to said Parcel E, Parcel F and Parcel G all in the SE¼ NE¼ of Section 21, Township 95 North, Range 14 West 14 West of the 5th P.M., Chickasaw County, Iowa, and WHEREAS, the Chairman of the Chickasaw County Board of Supervisors and the Chickasaw County Auditor shall be authorized to sign a Quit Claim Deed to Parcel E, Parcel F and Parcel G all in the SE¼ NE¼ of Section 21, Township 95 North, Range 14 West 14 West of the 5th P.M., Chickasaw County, Iowa transferring the property to the appropriate adjacent property owners, Gary Taylor and Barbara Richter. NOW, THEREFORE, BE IT HEREBY RESOLVED that Parcel E, Parcel F and Parcel G all in the SE¼ NE¼ of Section 21, Township 95 North, Range 14 West 14 West of the 5th P.M., Chickasaw County, Iowa is hereby abandoned and vacated and the Chairman of the Chickasaw County Board of Supervisors and the Auditor are hereby authorized to sign a Quit Claim Deed transferring any interest the County may have had in said Parcel E, Parcel F and Parcel G all in the SE¼ NE¼ of Section 21, Township 95 North, Range 14 West 14 West of the 5th P.M., Chickasaw County, Iowa to the appropriate adjacent property owners. Roll Call: All Ayes. Motion Carried. RESOLUTION NO. 04-24-17-20 A RESOLUTION ACCEPTING THE OFFER TO BUY REAL ESTATE AND ACCEPTANCE AND SELLING LOT 1 NW¼ SECTION 34, TOWNSHIP 97 NORTH, RANGE 12 WEST OF THE 5TH P.M. IN CHICKASAW COUNTY, IOWA. WHEREAS, Chickasaw County, Iowa owns Lot 1, NW¼ Section 34, Township 97 North, Range 12 West of the 5th P.M. in Chickasaw County, Iowa, and WHEREAS, this property is adjacent to land owned by Dennis F. Knutson and JoAnne Knutson, and WHEREAS, it is in the best interests of Chickasaw County, Iowa to sell Lot 1, NW¼ Section 34, Township 97 North, Range 12 West of the 5th P.M. in Chickasaw County, Iowa, and that said property be abandoned by Chickasaw County, Iowa for purpose of said sale. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Board of Supervisors of Chickasaw County, Iowa: 1. The best interests of Chickasaw County, Iowa, and the citizens thereof require that formal action be taken for the abandonment and sale of Lot 1, NW¼ Section 34, Township 97 North, Range 12 West of the 5th P.M. in Chickasaw County, Iowa. 2. That the sale of said property described in paragraph 1 above, be to Dennis F. Knutson and JoAnne Knutson for the sale price of $1.00 and other valuable consideration. 3. That at the public hearing held on April 24, 2017, there were no written objections filed nor any oral objections filed or registered with the Chickasaw County Board of Supervisors for the sale and abandonment of said property. 4. That at a meeting before the Board of Supervisors of Chickasaw County, Iowa, on the 24th day of April, 2017, the Chickasaw County Board of Supervisors do hereby accept the Offer to Buy Real Estate as presented by Dennis F. Knutson and JoAnne Knutson herein above and below and does hereby accept the sale price of ONE DOLLAR ($1.00) and other valuable consideration for Lot 1, NW¼ Section 34, Township 97 North, Range 12 West of the 5th P.M. in Chickasaw County, Iowa 5. That the Chickasaw County Chairman of the Board of Supervisors and the Chickasaw County Auditor are hereby directed to sign all of the appropriate documents to transfer said real estate pursuant to the terms and conditions set forth herein above. DONE THIS 24th DAY OF APRIL, 2017, BY THE CHICKASAW COUNTY BOARD OF SUPERVISORS, NEW HAMPTON, CHICKASAW COUNTY, IOWA, AT A MEETING HELD AT 9:45 O’CLOCK A.M. ON SAID DATE. Chairman opened the only sealed bid. The bid was from Dennis and Jo Knutson in the amount of $1.00. Motion by Carolan, Seconded by Tilkes to accept the bid in the amount of $1.00 from Dennis and Jo Knutson for Lot 1 NW ¼ in Section 34, Township 97 North, Range 12 W of the 5th P.M. Chickasaw County, Iowa. Roll Call: All Ayes. Motion Carried. The County Engineer Dusten Rolando met with the Board to discuss road departmental activities. Topics included: maintenance and service of vehicles; maintenance of gravel roads; road damage rains, fixing North couple miles; hauling spot rock in various areas; entrance permits in various areas; ditch cleaning permits; removing last of winter equipment; repaired signs, various areas; blading gravels, in between rains; Ivanhoe Court, box culvert; Boyd road bridge, east pier pile driven; budget amendment FY 17 May 15th; equipment operator advertise; working on quotes for 2 caterpillar motorgraders, etc. The Board reviewed the FY 2016-2017 County Budget Amendment. Discussion followed. Motion by Geerts, Seconded by Tilkes to set the public hearing for May 15, 2017 at 9:00 AM in the Boardroom for FY 2016-2017 County Budget Amendment. Roll Call: All Ayes. Motion Carried. The Board met with the Department Heads for a departmental update. Present were Dusten Rolando, Cindy Messersmith, Doug Welton, Sue Breitbach, Staci Schutte, Austen Seely, Pat Wegman, Martin Hemann, Anita Eschweiler and a member from the media. The Board discussed the Veteran’s Affairs Commission Board Members whether to advertise or not. Also present were County Attorney Pat Wegman and Assistant County Attorney Mark Huegel. Discussion followed. The Auditor’s Office is still waiting for a response from the Veterans Affairs Commission regarding the advertisement for the Veterans Affairs Director/Administrator position. A copy of the proposed ad and job description was mailed to the following Veterans Affairs Commission members (Jim Geerts, Wayne Moetsch, and Lisa Wilker) the week of April 10, 2017 for the Veterans Affairs Commission to review. Motion by Geerts to place an ad in the New Hampton Newspapers and Nashua Reporter for the Veteran’s Affairs Commission Board Members. Motion died for lack of second. Discussion followed. Motion by Tilkes, Seconded by Geerts to place an ad in the New Hampton Newspapers and Nashua Reporter for the Veterans Affairs Commission Board members. Roll Call: Ayes: Tilkes, Geerts, Hackman and Zoll. Nays: Carolan. Motion Carried. The Auditor will place the ad in the official newspaper (Supervisor Tilkes and Zoll reviewed the ad). The deadline to submit applications is May 12, 2017 at 4:00 PM in the Auditor’s office. Member from the media left at 11:25 AM. Assessor Doug Welton met with the Board to review and approve the 2017 Slough Bill applications for property tax exemption through the Soil Conservation Slough Bill approval process. Iowa law allows a 10% increase each year with the first year starting at 3,000 acres (in 1986). The County has 4,714.96 acres as of January 1, 2017 versus an acre count of 4,599.51 as of January 1, 2016. This is an increase of 115.45 acres. The present amount of acres that are allowed in the county is 5,314 acres. Seven applicants did not complete 2017 renewal process and were disallowed the exemption. Motion by Carolan, Seconded by Hackman to approve the list as presented for 2017 slough bill applications and authorize Chairman Signature to sign notifications to five property owners not renewing 2017 slough bill applications. Roll Call: All Ayes. Motion Carried. The Board recessed at 11:45AM and reconvened at 1:00 PM. At 1:00 PM the Board discussed the possible relocation of departments. Present were Dave Gorman, Dusten Rolando, Austen Seely, Janet Larsen, Mark Huegel, Staci Schutte and Pat Wegman. Supervisor Hackman reviewed and discussed the lease contract for the MH-DD building. The department heads addressed their concerns to the Board. Janet Larsen informed the Board that County Social Services (CSS) will cover the Chickasaw County office Monday through Thursday. Supervisor Carolan suggested continuing to lease the MH-DD building for another year to give the departments’ time to research and present the Board options. Discussion followed. Motion by Carolan, Seconded by Hackman to renew the lease agreement for an additional period of one year per renewal term for the MH-DD building which would then expire on June 30, 2018 and the Board will review the lease agreement in February 2018. Roll Call: All Ayes. Motion Carried. The Board discussed the possible agreement/contract with providers-Medical Examiners with Attorney Pat Wegman, Assistant County Attorney Mark Huegel and Attorney Jon Swanson via phone conference. Jon Swanson referred to Chapter 670 and Mr. Swanson will contact Heartland Insurance Risk Pool. Mr. Swanson will continue to update the County Attorney’s office. The Board also discussed with the County Attorney the 28E Agreement with the Northeast Iowa Community Action for General Assistance. The County Attorney’s Office will review the sample copy of a 28E agreement and update the Board. Sheriff Marty Hemann met with the Board to discuss and review quotes for equipment for the new patrol vehicle. Quotes received from Keltek Incorporated in the amount of $13, 664.91 (does not include radios); EMS One Electronic Engineering in the amount of $8,729.95 and Keltek Incorporated $1,705.99. Discussion followed. Sheriff Hemann informed the Board that by accepting the quotes from EMS-One Electronic Engineering and Keltek Incorporated (two vendors) it would save $3,228.97. Motion by Geerts, Seconded by Carolan to accept the low bids from EMS-One Electronic Engineering in the amount of $ 8,729.95 and Keltek Incorporated in the amount of $1,705.99 for equipment for the new patrol vehicle as per the recommendation of the County Sheriff.
