The Board convened on Monday, June 28, 2004 at with all members present: Boge, Huegel, Schueth, Pickar, Mattke. The meeting was called to order by Chairman Boge. Mail was opened and distributed.
Pat Wegman and Mark Huegel, CountyAttorney and Assistant, met with the Board to discuss current county enforcement traffic ordinances and possible action for adoption of resolution establishing $5 county enforcement surcharge as recommended by ISAC. Discussion followed as Attorney’s recommendation for set aside of county traffic ordinances and adoption of new $5 county enforcement surcharge recently enacted through the legislature. Discussion also included decision of crediting of the revenue to the County General Services fund.
Motion by Mattke, Seconded by Huegel, to adopt and authorize Chairman to sign Resolution establishing $5 ChickasawCounty enforcement surcharge. Roll Call: Four Ayes, with Schueth abstaining from the vote. Motion Carried. RESOLUTION 06-28-04-17. A RESOLUTION ESTABLISHING A FIVEDOLLARCOUNTY ENFORCEMENT SURCHARGE. WHEREAS, counties enforce the criminal laws passed by the State of Iowa, provide the county attorneys who prosecute criminals, and even provide the courtrooms where the criminal cases are tried, but do not receive any of the criminal fine money, which all goesto the State of Iowa; and WHEREAS, in an attempt to begin to address this inequity the 2004 Iowa Legislature passed House File 2569, which provides that if a court imposes a fine or forfeiture for any simple misdemeanor punishable as a scheduled violation pursuant to a citation issued by the sheriff, the court shall assess a five dollar county enforcement surcharge for each applicable violation, with the surcharge going to the county general fund of the county where the citation was issued; and WHEREAS, section 9 of House File 2569 requires that for this county enforcement surcharge to go into effect in a given county, the board of supervisors must adopt an enacting resolution; THEREFORE, BE IT RESOLVED BY THE BOARD SUPERVISORS OF CHICKASAW COUNTY that the Board adopts a five dollar county enforcement surcharge pursuant to House File 2569, with the surcharge to be assessed as of July 1, 2004. Motion by Pickar, Seconded by Huegel, to approve provider contract rate effective July 1, 2004 with Community Care for Heritage county residents. Roll Call: All Ayes. Motion Carried.
Tuesday, June 29th move for county mental health department to county location at 3 N. Walnut, was reviewed.
Motion by Huegel, Seconded by Pickar, to approve Cedar Valley Mental Health Contract block grant rate increase of 4% to $16,106.85, based on $1.23 x 13,095 as per 2000 Chickasaw County census, pending concurrence and Butler County funding. Roll Call: All Ayes. Motion Carried.
Motion by Huegel, Seconded by Schueth, to approve purchase of Ricoh copier at State of Iowa contract pricing of $4727.00 and maintenance agreement of $36.40 per month from IKON. Roll Call: All Ayes. Motion Carried.
The Lease Agreement with Community Care for Heritage Residence was reviewed for language content.
Motion by Schueth, Seconded by Mattke, to approve lease agreement at $5000.00 for Heritage Residence with Community Care, effective July 1, 2004. Roll Call: All Ayes. Motion Carried.
Community Care has made a purchase offer of $8500.00 for the 2001 Dodge Caravan and $4500.00 for the John Deere Lawn Mower, which was accepted by the Board.
Motion by Huegel, Seconded by Mattke to approve fireworks permits for Gerald Tieskotter and Rocky Burgart. Roll Call: All Ayes. Motion Carried.
Motion by Schueth, Seconded by Mattke to approve Board Minutes of June 21 & 22, 2004. Roll Call: All Ayes. Motion Carried.
