COUNTY BOARD MINUTES JUNE 20, 2016 The Board convened on Monday, June 20, 2016 at 9:00 AM with the following members present: Holthaus, Geerts, Zoll, and Andersen. Absent: Carolan. The meeting was called to order by Chairman Andersen. Mail was opened and distributed. Motion by Geerts, Seconded by Holthaus to approve the agenda for June 20, 2016. Roll Call: Ayes: Geerts, Holthaus, Zoll and Andersen. Absent: Carolan. Motion Carried. Motion by Zoll, Seconded by Geerts to approve the board minutes of June 13 & 14, 2016. Roll Call: Ayes: Geerts, Holthaus, Zoll and Andersen. Absent: Carolan. Motion Carried. Motion by Holthaus, Seconded by Zoll to re-appoint James Geerts to the Veterans Affairs Commission Board for a three year term beginning July 1, 2016 and ending June 30, 2019. Roll Call: Ayes: Geerts, Holthaus, Zoll and Andersen. Absent: Carolan. Motion Carried. Motion by Geerts, Seconded by Holthaus to approve fireworks permit for Bob Galligan. Chief Deputy Marty Hemann met with the Board to discuss the purchase of a vehicle for the Sheriff’s Department. Discussion followed. Motion by Holthaus, Seconded by Carolan to authorize Chief Deputy to purchase a 2017 Dodge Durango from Vern Laures Auto Center Inc. in the amount of $26,483.00 for the Sheriff’s Department. Roll Call: Ayes: Geerts, Holthaus, Carolan and Andersen. Nays: Zoll. Motion Carried. Motion by Holthaus, Seconded by Carolan to approve Resolution for Interfund Operating Transfer. RESOLUTION NO. 06-20-16-21 RESOLUTION FOR INTERFUND OPERATING TRANSFERS WHEREAS, it is desired to authorize the County Auditor to periodically transfer funds from the General Basic Fund to the General Supplemental Fund during the FY 2016-2017 budget year, and WHEREAS, said transfers must be in accordance with Section 331.432, Code of Iowa, and NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Chickasaw County, Iowa, as follows: 1. The total maximum transfers from the General Basic Fund to the General Supplemental Fund for the fiscal year beginning July 1, 2016 shall not exceed $400,000. 2. The amount of any transfer shall not exceed available fund balances in the transferring fund. 3. The Auditor is directed to correct her books when said operating transfers are made and notify the Treasurer of the amounts of said transfers. RESOLUTION 06-20-16-22 RESOLUTION FOR INTERFUND OPERATING TRANSFERS WHEREAS, it is desired to authorize the County Auditor to periodically transfer funds from the General Basic Fund to the Ambulance Fund during the FY 2016-2017 budget year, and WHEREAS, said transfers must be in accordance with Section 331.432, Code of Iowa, and NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Chickasaw County, Iowa, as follows: 1. The total maximum transfers from the General Basic Fund to the Ambulance Fund for the fiscal year beginning July 1, 2016 shall not exceed $12,500. 2. The amount of any transfer shall not exceed available fund balances in the transferring fund. 3. The Auditor is directed to correct her books when said operating transfers are made and notify the Treasurer of the amounts of said transfers. RESOLUTION 06-20-16-23 RESOLUTION FOR INTERFUND OPERATING TRANSFERS WHEREAS, it is desired to authorize the County Auditor to periodically transfer funds from the General Basic Fund to the Capital Projects Fund during the FY 2016-2017 budget year, and WHEREAS, said transfers must be in accordance with Section 331.432, Code of Iowa, and NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Chickasaw County, Iowa, as follows: 1. The total maximum transfers from the General Basic Fund to the Capital Projects Fund for the fiscal year beginning July 1, 2016 shall not exceed $100,000. 2. The amount of any transfer shall not exceed available fund balances in the transferring fund. 3. The Auditor is directed to correct her books when said operating transfers are made and notify the Treasurer of the amounts of said transfers. RESOLUTION 06-20-16-24 RESOLUTION FOR INTERFUND OPERATING TRANSFER WHEREAS, it is desired to authorize the County Auditor to periodically transfer funds from the Economic Development-GB Fund to the Chickasaw County Tourism Fund during the FY 2016-2017 budget year, and WHEREAS, said transfers must be in accordance with Section 331.432, Code of Iowa, and NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Chickasaw County, Iowa, as follows: 1. The total maximum transfers from the Economic Development-GB Fund to the Chickasaw County Tourism Fund for the fiscal year beginning July 1, 2016 shall not exceed 7,500.00. 2. The amount of any transfer shall not exceed available fund balances in the transferring fund. 3. The Auditor is directed to correct her books when said operating transfers are made and notify the Treasurer of the amounts of said transfers. The total maximum transfers from the Rural Services Basic Fund to the Ambulance Fund for the fiscal year beginning July 1, 2016 shall not exceed $12,500. 2. The amount of any transfer shall not exceed available fund balances in the transferring fund. 3. The Auditor is directed to correct her books when said operating transfers are made and notify the Treasurer of the amounts of said transfers. RESOLUTION 06-20-16-27 RESOLUTION FOR INTERFUND OPERATING TRANSFER WHEREAS, it is desired to authorize the County Auditor to periodically transfer funds from the Rural Services Basic Fund to the Secondary Road Fund during the FY 2016-2017 budget year, and WHEREAS, said transfers must be in accordance with Section 331.432, Code of Iowa, and NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Chickasaw County, Iowa, as follows: 1. The total maximum transfers from the Rural Services Basic Fund to the Secondary Road Fund for the fiscal year beginning July 1, 2016 shall not exceed $1,588,724.00. 2. The amount of any transfer shall not exceed available fund balances in the transferring fund. 3. The Auditor is directed to correct her books when said operating transfers are made and notify the Treasurer of the amounts of said transfers. RESOLUTION 06-20-16-28 RESOLUTION FOR INTERFUND OPERATING TRANSFER WHEREAS, it is desired to authorize the County Auditor to periodically transfer funds from the Rural Services Basic Fund to the Landfill Fund during the FY 2016-2017 budget year, and WHEREAS, said transfers must be in accordance with Section 331.432, Code of Iowa, and NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Chickasaw County, Iowa, as follows: 1. RESOLUTION NO. 06-20-16-29 APPROPRIATIONS RESOLUTION WHEREAS, it is desired to make appropriations for all officers and departments for the fiscal year beginning July 1, 2016, in accordance with Section 331.434, Subsection 6, Code of Iowa. NOW THEREFORE, BE IT RESOLVED by the Chickasaw County Board of Supervisors of Chickasaw County, Iowa, as follows: Section 1. The amounts itemized by fund and by department or office is hereby appropriated as per adopted budget. Section 2. Subject to the provisions of other county procedures and regulations, and applicable state law, the appropriations authorized under Section 1 shall constitute authorization for the department or officer to make expenditures or incur obligations from the itemized fund, effective July 1, 2016. Section 3. In accordance with Section 331.437, Code of Iowa, no department or officers shall expend or contract to expend any money or incur any liability, or enter into any contract which by its terms involves the expenditures of money for any purpose in excess of the amounts appropriated pursuant to this Resolution. Section 4. If at any time during the 2016/2017 budget year the Auditor ascertains that the available resource of a fund that year will be less than said funds total appropriation, the Auditor shall immediately so inform the Board of Supervisors and recommend appropriate corrective action. Section 5. The Auditor shall establish separate accounts for the appropriations authorized in Section 1, each of which account shall indicate the amount of the appropriation, the amount charged thereto, and the encumbered balance. The Auditor shall report the status of such accounts to the applicable departments and officers monthly or quarterly during the fiscal year 2016/2017. Section 6. All appropriations authorized pursuant to this Resolution lapse at the close of business on June 30, 2017.PASSED, APPROVED, AND ADOPTED this 20th day of June, 2016, the vote thereon being as follows: AYES: /ss/ John Andersen, Steve Geerts, and Rick Holthaus. Also present were Assistant County Attorney Mark Huegel and Dave Bonfig. Topics included: maintenance and service of vehicles; maintenance of gravel roads; V-14 pipe work continues; entrance permits; pouring concrete, PCC patches on V-14; work orders in various areas; closing roads, rain, flash floods; blades out; spot rocking on Pembroke Avenue; retrieve shoulders in Ionia areas; spot rocking on 150th Street; mowing gravels in Lawler; mowing gravels in Saude; pouring concrete, box culver, Alta Vista Road; survey on V-14 future project; tandem truck quotes today; etc. Motion by Holthaus, Seconded by Geerts to approve Resolution Directing the Chickasaw County Auditor to publish Notice of Hearing on the adoption of an ordinance to establish a policy for the construction and reconstruction of roadways and bridges on the Chickasaw County Secondary Road system. RESOLUTION NO. 06-20-16-30 RESOLUTION DIRECTING THE CHICKASAW COUNTY AUDITOR TO PUBLISH NOTICE OF HEARING ON THE ADOPTION OF AN ORDINANCE TO ESTABLISH A POLICY FOR THE CONSTRUCTION AND RECONSTRUCTION OF ROADWAYS AND BRIDGES ON THE CHICKASAW COUNTY SECONDARY ROAD SYSTEM WHEREAS, the Board of Supervisors of Chickasaw County, Iowa, has determined that it is in the best interest of the citizens of Chickasaw County to establish a Chickasaw County Policy for the construction of roads, reconstruction of roads, construction of bridges, reconstruction of bridges and other roadway and drainage futures associated with road and bridge construction, and WHEREAS, the Chickasaw County, Board of Supervisors has caused to be prepared and filed with the Chickasaw County Auditor, a copy of an Ordinance establishing a policy for the construction and reconstruction of roadways and bridges on the Chickasaw County Secondary Road System, and WHEREAS, a public hearing shall be set at which time and place the said Chickasaw County, Board of Supervisors will consider arguments for or against the adoption of the proposed amended Ordinance establishing a policy for the construction and reconstruction of roadways and bridges on the Chickasaw County Secondary Road System. NOW, THEREFORE, BE IT HEREBY RESOLVED that a public hearing thereon will be held in the Chickasaw County Board of Supervisors meeting room at the Courthouse in New Hampton, Chickasaw County, Iowa on the 11th day of July, 2016, at 10:00 o’clock a.m., at which time and place the Chickasaw County Board of Supervisors will consider arguments for or against the adoption of the proposed Ordinance. BE IT FURTHER RESOLVED that the Chickasaw County Auditor is hereby authorized and directed to cause to be published notice of such hearing on the time not less than four (4) days or more than twenty (20) days prior to the date herein established for hearing as provided by law. A copy of said Notice of Public Hearing is attached hereto marked Exhibit “A”, and is incorporated herein as though set forth verbatim. Knoll, Auditor EXHIBIT “A” NOTICE OF PUBLIC HEARING The Chickasaw County Board of Supervisors will hold a public hearing at 10:00 o’clock a.m. on the 11th day of July, 2016, in the Board of Supervisors’ meeting room at the Courthouse in New Hampton, Iowa. The purpose of this hearing is to consider Chickasaw County Ordinance No. VI-4, establishing a policy for the construction and reconstruction of roadways and bridges on the Chickasaw County Secondary Road System. This ordinance will set the minimum design standards that Chickasaw County will follow in the construction or reconstruction of roads and bridges. A copy of the proposed ordinance is available at the office of the Chickasaw County Auditor for public inspection and copies may be obtained at the Auditor’s Office. Anyone wishing to speak in support of or opposition of this ordinance should be present at this hearing. Written comments in support or opposition of this ordinance may be sent to Board of Supervisors, Box 311, New Hampton, Iowa 50659 on or before the date set for hearing. Notice is hereby given that pursuant to Iowa Code Section 331.302(5), the Chickasaw County Board of Supervisors are suspending the multiple reading requirements provided for in Section 331.302 and plan to approve this ordinance at this meeting. County Engineer reviewed the quotes for the tandem truck with equipment with the Board. Discussion followed. Motion by Holthaus, Seconded by Zoll to approve the purchase of a 2017 Mack GU713 tandem dump truck with equipment from GATR of Cedar Rapids in the amount of $214,500.00 as per the recommendation of the County Engineer and the expenditure to be paid from the FY 17 budget. Roll Call: Ayes: Geerts, Zoll, Holthaus and Andersen. Nays: Carolan. Motion Carried. Mark Zaccone with Invenergy met with the Board for an update on the wind turbine project. The Board continues to be supportive of the wind turbine project. Mr. Zaccone informed the Board that 18, 500 acres are under leases, 2,200 acres are committed, 10,000 acres are under consideration by the landowners, and landowners representing 900 acres are not interested in leasing at this time. Mr. Zaccone informed the Board that the next step would be to erect two 200-220 foot towers this summer in the County to collect wind speed data. The towers will be on one landowner’s property. Mr. Zaccone will continue to update the Board on the progress of the project. Motion by Carolan, Seconded by Holthaus to acknowledge the hiring of Kathy Feuling as a part-time scheduled Quality Assurance and Quality Improvement Coordinator at the rate of $25.00 per hour effective June 6, 2016 with the Public Health and Home Care Services Agency.
