COUNTY BOARD MINUTES JULY 11 & 12, 2016 The Board convened on Monday, July 11, 2016 at 9:00 AM with all the members present: Carolan, Holthaus, Geerts, Zoll, and Andersen. The meeting was called to order by Chairman Andersen. Mail was opened and distributed. Motion by Geerts, Seconded by Holthaus to approve the agenda for July 11 & 12, 2016. Roll Call: All Ayes. Motion Carried. Motion by Holthaus, Seconded by Geerts to approve the board minutes of June 27 & 28. Roll Call: All Ayes. Motion Carried. Motion by Geerts, Seconded by Carolan to approve the board minutes of July 4, 2016. Roll Call: All Ayes. Motion Carried. Ken Rasing met with the Board for an update on the Heritage Residence roof. Also present was Dave Gorman. Ken Rasing contacted the manufacturer of the steel shingles and filed a claim. Ken Rasing informed the Board that he is still working with the manufacturer, will contact a vendor who installs the manufacturer shingles to evaluate the roof and continue to update the Board. Mr. Rasing informed the Board that the water quality inspection report for the Heritage Residence has been received and water quality meets the standards. Mr. Rasing informed the Board that there were 15 medical examiner cases since January 2016 as compared to 16 cases for the calendar year 2015 and 20 cases in calendar year 2014. Mr. Rasing also informed the Board that soil samples were taken on Friday, July 8, 2016 for the radio tower project, and that we are awaiting the engineer’s report. The radio tower project is proceeding as planned. Mr. Rasing informed the Board that the Department of Natural Resources approved the agreement with the City of Fredericksburg for the Landfill and Mr. Rasing is in the process of drafting another agreement. Mr. Rasing informed the Board that the 2016 Sanitation pickup is ready and that Mr. Rasing will take sealed bids for the old Sanitation pickup. Motion by Holthaus, Seconded by Zoll to enter into a contract with Operation Threshold-WIC program and authorize Chairman Signature. Roll Call: All Ayes. Motion Carried. Motion by Zoll, Seconded by Holthaus to open the public hearing at 10:01 AM for the Chickasaw County Ordinance VI-4 to establish a policy for the construction and reconstruction of roadways and bridges on the secondary road system. Roll Call: All Ayes. Motion Carried. Also present from the public were Assistant County Attorney Mark Huegel and County Engineer Dusten Rolando. No written or oral comments from the public. Motion by Carolan, Seconded by Geerts to close the public hearing at 10:06 AM. Roll Call: All Ayes. Motion Carried. Motion by Zoll, Seconded by Carolan to suspend the rules per Iowa Code Section 331.302(6) (a) requiring a second and third (final) readings of Ordinance No. VI-4 to establish a policy for the construction and reconstruction of roadways and bridges on the secondary road system. Roll Call: All Ayes. Motion Carried. Motion by Holthaus, Seconded by Zoll to adopt Ordinance No. VI-4 to establish a policy for the construction and reconstruction of roadways and bridges on the secondary road system. Roll Call: All Ayes. Motion Carried. County Engineer Dusten Rolando met with the Board to discuss road departmental activities. Topics included: maintenance and service of vehicles; maintenance of gravel roads; entrance permits; ditch cleaning permits; Airport Lake, dirt work, playground this week; driveway repair work, this week in various locations; repair signs in various locations; spraying brush in various locations; retrieving rolling, couple days left; Tom Speltz, Pat Gleason mowing in various locations; spot rocking in various locations; extra edge rutting this week after retrieving; blading gravels; contract rock, Division 1 and 2 yet to start, calling today; bridge repair county line, mainline open; some rip rap remains, county line; bridge crew heading to box culvert, Ridgeway Blvd. next; signing, closing, box culvert; Alta Vista box culvert, dire work, flowable mortar; rock sample at Platte Quarry; survey work, box culvert, Ridgeway Blvd; Boyd Road bridge; design pile; sidewalk parking, Sheriff’s office, nurses; Meeting with Chuck Goodman, Heartland Insurance Risk Pool today at 1:00 and 2:00 PM; etc. Motion by Holthaus, Seconded by Geerts to approve the permit for Windstream Communication Inc. to place buried cable along the south side of 100th street approximately ¼ mile east of Gilmore Avenue. Roll Call: All Ayes. Motion Carried. Motion by Carolan, Seconded by Geerts to approve the permit for Allamakee-Clayton Electric Cooperative to place overhead power lines, poles, anchors in the county right of way along 240th Street west of Fayette County line. Roll Call: All Ayes. Motion Carried. Motion by Zoll, Seconded by Geerts to approve Abby Lea’s Liquor License. Roll Call: All Ayes. Motion Carried. Motion by Holthaus, Seconded by Geerts to approve Assumption of the Blessed Virgin Mary Church Liquor License. Roll Call: All Ayes. Motion Carried. Motion by Zoll, Seconded by Holthaus to approve the fireworks permit for Alan Wood. Roll Call: All Ayes. Motion Carried. Motion by Geerts, Seconded by Carolan to approve the fireworks permit for Tony Utley. Roll Call: All Ayes. Motion Carried. Motion by Carolan, Seconded by Zoll to approve the fireworks permit for Tony Pleggenkuhle. Roll Call: All Ayes. Motion Carried. Motion by Holthaus, Seconded by Geerts to approve resolution establishing a minimum balance of $500,000.00 in the Chickasaw County Sanitary Landfill Account and designation the Chickasaw County Sanitary Landfill Account as a restricted fund. Roll Call: All Ayes. Motion Carried. Motion by Geerts, Seconded by Holthaus to reconsider the Resolution No. 07-11-16-34 and add the following language to Resolution No. 07-11-16-34 in italics “methane gas control and providing and maintaining appropriate ground cover” Roll Call: All Ayes. Motion Carried. RESOLUTION NO. 07-11-16-34A RESOLUTION ESTABLISHING A MINIMUM BALANCE OF $500,000.00 IN THE CHICKASAW COUNTY SANITARY LANDFILL ACCOUNT AND DESIGNATING THE CHICKASAW COUNTY SANITARY LANDFILL ACCOUNT AS A RESTRICTED FUND. WHEREAS, Chickasaw County received Closure Permit Number 19-SDP-1-72C on March 5, 1998 for the closure of the Chickasaw County Sanitary Landfill. WHEREAS, The Chickasaw County Closure Permit has an expiration date of March 5, 2028; and WHEREAS, Chickasaw County as a part of the Closure Permit is required to monitor, inspect and maintain the landfill in accordance with the approved Hydrologic Monitoring System Plan and the Leachate Control System Plan, and WHEREAS, in monitoring the landfill as required expenditures have occurred and will continue to occur in the future, and WHEREAS, the costs of maintaining and correcting water quality control, leachate control, methane gas control and providing and maintaining appropriate ground cover may exceed the sum of $500,000.00. NOW, THEREFORE, BE IT HEREBY RESOLVED that a minimum balance of $500,000.00 should be maintained in the Chickasaw County Sanitary Landfill Account and said account shall further be designated as a restricted fund. DONE THIS 11th DAY OF JULY, 2016, BY THE CHICKASAW COUNTY BOARD OF SUPERVISORS, NEW HAMPTON, CHICKASAW COUNTY, IOWA, AT A MEETING HELD AT 9:00 O’CLOCK A.M. ON SAID DATE. AYES: /ss/ John Andersen, Chairman, Board of Supervisors, Rick Holthaus, Dan Carolan, Tim Zoll and Steve Geerts. NAYS: None. ATTEST: /ss/ Joan E. Knoll, Chickasaw County Auditor. Veterans Affairs Director met with the Board. Also present was Wayne Moetsch, County Attorney Pat Wegman, and Assistant County Attorney Mark Huegel. Motion by Carolan, Seconded by Geerts to enter closed session as per Iowa Code Section 21.5 (1) (i) at 10:46 AM. Roll Call: All Ayes. Motion Carried. Discussion followed. Motion by Geerts, Seconded by Carolan to exit closed session at 11:25 A.M. Roll Call: All Ayes. Motion Carried. Assessor Doug Welton met with the Board to discuss the disallowance of a 2015 Homestead/Military Application. Motion by Zoll, Seconded by Carolan to disallow the 2015 Homestead and Military Applications as per the recommendation of the County Assessor and authorize the Chairman to sign. Roll Call: All Ayes. Motion Carried. Received and filed in the Auditor’s Office MMP short form for annual updates for Harrington LTD-Finisher Farm (ID #58790) in Section 26 of Bradford Township located at 1646 290th Street, Nashua, IA 50658. Motion by Geerts, Seconded by Carolan to adjourn the meeting at 12:08 PM. Roll Call: All Ayes. Motion Carried. The Board convened on Tuesday, July 12, 2016 at 9:00 AM with all the members present: Carolan, Holthaus, Geerts, Zoll, and Andersen. The meeting was called to order by Chairman Andersen. Mail was opened and distributed. Also present was Assistant County Attorney Mark Huegel and a member from the media. Chief Deputy Marty Hemann met with the Board to discuss the City of New Hampton Communications for FY 16-17. Also present was City of New Hampton Mayor Debra Larsen. Marty Hemann presented to the Board a letter from his department regarding the communication (dispatching services) for the City of New Hampton and City of Nashua through recent years. Discussion followed. Mayor Larsen will discuss the concern with the City of New Hampton Council. The Sheriff’s office and the County Attorney’s office will review all the contracts and update the Board at a later date. Supervisor Holthaus gave an update on the Adolph Munson Park Task Force meeting held on July 7, 2016. Discussion followed. The Adolph Munson Park Task Force will contact the County Attorney’s office and will continue to update the Board of their progress. Supervisor Holthaus gave an update on the Conservation Board meeting held on July 7, 2016. Conservation tours of the areas are scheduled for August 10, 2016 at 3:45 PM and August 23, 2016 at 5:00 PM. Conservation Department will use other vendors for road rock. Dan Shrock will present to the Conservation Board information about security camera possibilities in the parks and present a proposal at a later date. Conservation Department sent information to Tom Hurd of Twin Turbines Energy in Mason City for solar power for the Twin Ponds Nature Center and for budgeting purposes in the future. The New Hampton Lion’s Club will help with the construction of the playground equipment on July 16, 2016 at the Airport Lake Park. The Conservation Department will have a recycle bin at Twin Ponds Nature Center for collection of recyclable materials from Airport Lake Park, Split Rock Park, and Twin Ponds Nature Center. Departmental cash certifications from fiscal year ending June 30, 2016 were reviewed. Motion by Geerts, Seconded by Zoll to accept the Departmental Cash Certifications ending June 30, 2016 and place on file, subject to audit. Roll Call: All Ayes. Motion Carried. Motion by Carolan, Seconded by Geerts to approve the Fireworks Permit for Andy Trask. Roll Call: Ayes. Motion Carried. The Board allowed claims. Supervisor Geerts left at 10:47 AM. The Board recessed at 11:05 AM and reconvened at 1:00 PM. Joe Denner met with the Board to discuss Union Safety Concerns. Also present were County Attorney Pat Wegman, Assistant County Attorney Mark Huegel, and County Engineer Dusten Rolando. Discussion followed.
